Urgent Supervisa Help Needed for my aged Mother

Dear all,

When I got My PR and made my first move to Canada, you guys were of great help and I really appreciate you all, especially the Seniors for their immense help. This is the second phase of my moving to this great land and I need help from you guys. Hope you guys will bail me out on these very important queries below:

Situation As it is:
We are a family of three (Me, my spouse and my daughter) who got their PR in Feb 2012. My wife has been living here in Canada since then where as I had to move back to India with my daughter to look after Mother. I am back for here for 3 weeks and will make a permanent move by the end of Dec 2013. My wife is currently earning around 1500 CAD per month.

In India:
I want my mother to move with me When I make a permanent move this Year. I assume we require the Supervisa for her.

The Queries:

1) Can I apply for my mother's supervisa while I'm not in living in Canada all this while, or can my wife do the same as she has been living here for a year now? Also, Can my Indian Income be clubbed along with my spouse's CAD 18,000 pa/ earnings when we apply for her Supervisa.

2) Do you suggest her to come here on a visitor Visa in the middle of this year for a month or so before we apply for her Supervisa in the year end.

3) Will her own Financial Assets make the case stronger? If Yes how much money we need on her account.

4) I am also looking forward to apply for a Canadian student permit for my minor nephew, who studies there in the 6th Standard. I want him to pursue his education here after i make the permanent move. Is it possible?

5) My Brother in Law holds a Diploma in Pharmacy (done after 10th Std.) but he has done his 10+2 after a gap of around 8 years. He has enough work experience as a Pharmacist. His wife holds a Bachelor's Degree in Commerce and has also cleared her IELTS. She also has around 10 years + experience as an accountant in the bank. Is the duration of his Education sufficient according to the new Skilled Worker Immigration requoirement?

6) If not can we proceed their case on my Sister's basis, Is her Commerce degree featured on the wanted skills list this year?

I know these are lots of questions but consultants in India not only give the false information but often try to dupe you. So I'm looking forward to all you guys for some real help.

You should post your Skilled Worker questions to the Skilled Worker section of this forum and your student visa questions to the International Students section of this forum.

You must sponsor your mother for the super visa (your wife cannot). To qualify to sponsor your mother, you must meet minimum income requirements. Since you are a family of three + your mother, you will have to show income of $42,065 to qualify to sponsor your mother for a super visa. So no, 18K per year is definitely not enough.

If you don't qualify to sponsor your mother for the super visa, she can try applying for a regular visit visa.

You mother cannot make a permanent move to Canada under either the super visa or a regular visit visa. All she can do is visit.

You would have to sponsor her for PR in order for her to make a permanent move to Canada once she is approved for PR. As I'm sure you're aware, CIC is not accepting parent/grandparent sponsorship applications at this time. We expect CIC will start accepting applications again around November / December of this year.

Just to add...

You mother cannot make a permanent move to Canada under either the super visa or a regular visit visa. All she can do is visit.

You would have to sponsor her for PR in order for her to make a permanent move to Canada once she is approved for PR. As I'm sure you're aware, CIC is not accepting parent/grandparent sponsorship applications at this time. We expect CIC will start accepting applications again around November / December of this year.

Dear All,

It's been very depressing days, lately. As I discussed with you that I'm still based in Indian and will be moving here by this year end and wanted my mother to join me here at that time. But as seniors suggested I can't apply for her Supervisa for not meeting the LICO requirement.

Hence I talked to someone about the regular VISITOR VISA for her so that she can stay with me for at least 6 months, even there he suggested that Low income cut off (LICO) limit may come in picture for her VISITOR VISA.

Is it really true that when visitor visa application's are filed for parents, officers look at LICO. If your income is not equal to LICO, officer may refuse your application.

She has some Fixed Deposits in her name. BTW what amount of money in cash or FD is enough to satisfy the VISA officer for a Visiting Senior.

Is the BUYING the Return Ticket mandatory and should be Attached with the Visitor Visa Application

I'm planning to apply for her Visitor Visa in May 2013, should I apply the single entry or Multiple Entry

Can anyone already well-settled here can sponsor or invite her instaed of my wife who earns just 18000CAD per year. Will that help?

The main issue with the visitor visa is that your mother will have to prove she has strong ties to her home country and has no plans to remain in Canada long term. She should also be able to show that she has sufficient funds to pay for her visit here. Alternatively, you can show that you have funds to support her while she's here. And no, the fact that your income is not equal to LICO will not be grounds for refusal.

I would recommend you apply for a single entry visa. To be honest, there's a decent chance your mother's visitor visa application will be refused and it's typically easier to be approved for a single entry visa than a multiple entry visa.

Including an airline ticket with the application isn't mandatory. If you do, I'd recommend you make it a refundable ticket in case your mother is refused.

Can an already well-settled Canadian National sponsor or invite her instead of my wife who earns just 18000CAD per year. Will that help? Or only I as a PR can file her case on my behalf from India.

Apart from her FDs and Bank statements Can I specify the detailed reason in Mother's Visa application that - being a grandmother she is taking my 4 year old to meet her Mother (My Wife in Canada) while I'm back in India due to Work Commitments. It's a true and valid humanitarian ground, will this this help our case with the Visa officer

Budfox doesn't qualify to apply for the super visa because he doesn't have sufficient income. His mother is going to apply for a regular visit visa instead. When you apply for a regular visit visa - you can either apply for a single or multiple entry.
