But if I apply and found that I am not eligible and that pathway is not for me and they refuse our application. Do we just get refused or prosecuted for applying for this program?

I do not know the specifics of that pathway, but basically as long as you tell the truth and disclose all material facts, no, they will not punish you and it should not affect future applications.
