Hi there,

I guess I need an advice. Please, have a look at my story and give any recommendations.

My spouse was refused application for US visa several years ago. She got another one a year later.

In my application (e-APR) I answered YES to the question 'Has ____ ever been refused a visa or permit, denied entry or ordered to leave Canada, or any other countries?' and gave explanations.

But I answered NO to the question 'Has ___ been refused refugee status, or an immigrant or permanent resident visa, or visitor or temporary resident visa, to Canada or any other countries.

Now I received a request for additional documents (IMM5669E form) for my spouse, and need to give an explanation inside the form. There're same questions inside.

Should my spouse:
A. Leave everything as it was in original application (YES to 'ever been refused a visa or permit' question and NO to 'been refused refugee status' question)
B. Answer NO to 'ever been refused a visa or permit' question and YES to 'been refused refugee status' question and give explanation, including WHY I changed the answers. The risk is that there will be differences.
C. Answer YES to both and give explanation WHY I changed the answers.

Please, help, me with your proper advice. I have a limitation in time and need to submit the form shortly.
THANKS!

Hi..
It is tough but a good explanation will help you. If I were you I will answer YES to both, and explain them beautifully about my innocence in understanding of the questions.

I would say that both questions seems exactly similar so you were not sure how to answer them. You answered YES to first as it was sepcifically about visa refusals. You answered NO to the second as in your understanding it was more about refugee status.
Explain that you just realized after careful reading of many times that the answer should be yes to both, as both questions has the visa refusal part. Also specify that you are still not sure the main difference in the questions, but in essence, I (your wife) was refused US visa on xx-xx-xxxx date due to this reason and I (your wife) thinks that it is appropriate to answer both question as YES based on explanation above and there is no other instance of visa refusal. Again specify that the difference between two questions can not be judged.

I hope it help.

I thought to explain same thing, but in IMM5669 answer YES to the question:
Has ___ been refused refugee status, or an immigrant or permanent resident visa, or visitor or temporary resident visa, to Canada or any other countries.

and NO to the question:
Has ____ been refused admission to, or ordered to leave, Canada or any other country.

as the second question in IMM is different from the main form (Has ____ ever been refused a visa or permit, denied entry or ordered to leave Canada, or any other countries)

and give the further explanation like you did. Thanks again by the way

That is exactly how you should take this matter.
You are welcome and good luck !
