URGENT!!!-----Inland pr and expired visitor

My husband and I sent out Inland PR application along with OWP application in January.
However, I am shocked to know that one of our form( IM0008) was outdated!!! Newest update is in November 2015 and we downloaded the package in October to prepare everything.

We think CIC will return the whole package in several months and he will lose his status in Canada so it's impossible for him to get a OWP in 4 months!!!!!

However, He has a visitor visa and already lived for 6 months from August 2015 to January 2015. So now he is kind of out of status even under implied status.

1. Can we apply for visitor extension now? Because he's in implied status, technically his visitor status doesn't expire. The processing time for visitor record is 115 days now so basically we will receive the whole PR package before we get an answer for visitor record.

2. After we apply for the visitor record, will he be also in an implied status under visitor record application so he is not outdated And still eligible for an OWP? Can we resubmit the PR application and OWP before we get an answer for visitor record? Or we need to wait for a real visitor record to arrive then apply?

3. If extending his visitor status now is not possible, can we do a restoration right now?


I know it's quite messed up now!!! We were too confident in our PR application before so did not extend his visitor status in the first place before it expires.

What can we do right now???? I'm really nervous and desperate now!!!! He does not want to leave Canada also he wants an OWP asap to have a job. We want to stay together all the time.......

Sometimes CIC will simply ask for the updated form...sometimes, they do return the entire application. At this point, it is in your best interest to assume that they will return the entire package.

It sounds like you're saying that his visitor status expired last month (not January 2015), correct? If that's the case, he must now apply for Restoration of Status ASAP. If that is approved, he will then be back in status and could then apply for the OWP. This scenario would only apply IF the entire application is returned.

If the application is not returned, he should see the OWP ~ May of this year.


Either way, applying for ROS now is a smart way to be prepared...just in case.

I did extend mg vitors visa to be on the safe side. However i did mine right on the day my status was expiring so i didnf have to apply for the restoration. You might want to apply for your restoration soon. Its better to have them dealth with rivht away.
