Hello Community,

I'm seeking advice on behalf of a friend who arrived in Canada in December 2019 and filed a refugee claim. He disclosed in his Basis of Claim (BOC) form that he had a previous refugee claim in the UK in 2007. His initial hearing with the Refugee Protection Division (RPD) / Immigration and Refugee Board (IRB) took place in December 2020, but it was postponed due to issues with the interpreter, who had a different dialect. The same problem occurred at a subsequent hearing scheduled for May 2021, leading to another postponement. In 2021, he received a letter from the IRB stating that his case was being referred for a Pre-Removal Risk Assessment (PRRA) and that he was ineligible due to the UK claim, which he had already disclosed.

He moved to Mississauga in 2022, and his file was transferred there. When he later decided to move back to Calgary for work, he informed the Mississauga CBSA office. The officer requested his Refugee ID (Brown Paper) that he will get it back in Calgary from CBSA office. Since then, he has faced difficulties retrieving his Refugee ID. His IDs have expired, and he has been waiting for his work permit renewal for over a year with no progress. Despite numerous visits to the CBSA office and calls to IRCC, he has received no resolution. The prolonged stress has significantly impacted his mental health, leading to a two-week hospitalization in a mental health ward.

We need advice on how he can obtain his Refugee ID/Brown Paper, what steps he should take to address the work permit renewal issue, and what additional support or resources might be available to help him during this challenging time.

It appears that he has been refused asylum already because he was ineligible. Likely why he can’t get a WP. What happened with PPRA? What happened with his UK asylum claim and how did he get to Canada?

His claim was not refused by the IRB but was deemed ineligible for consideration by the IRB and needs to be addressed by CBSA as a PRRA applicant. The only response he has received is that his case/work permit is "in progress." His driver's license and other documents have expired and does not have any have access to healthcare. Additionally, His UK asylum claim was withdrawn, and he entered Canada from the US, where he was on a visitor visa.

The only response he has received regarding his PRRA was about 1.5 years ago, requesting him to submit any supporting documents he has, but there has been no progress since then. Whenever he follows up with his lawyer about the PRRA or seeks assistance with obtaining the brown paper, the lawyer advises him to contact IRCC. IRCC directs him to CBSA, and CBSA informs him that they do not handle the brown paper and advises him to speak with IRCC. He is caught in a cycle of being passed from one to the other with no resolution in sight.

That is somewhat by design. He may up in limbo even if he receives positive PPRA where he doesn’t have status in Canada but Canada can’t remove him. The hope is he removes himself. Where is he from? How long had he been in the UK and why did he withdraw his asylum case? Did he return home after that? Surprising he got a US visa after the UK asylum claim.

Pakistan, is there any office or organization where he can seek help with obtaining a Refugee ID or the brown paper back?

That’s is absolutely INCORRECT you know why? Because whenever a claimant received a positive PRRA have status and he is qualified to GET PR under protected person

Not correct. Positive PPRA does not guarantee approval as a protected person.

In most cases, you become a protected person after we accept your PRRA application. After that, you can apply for permanent residence.

Yes, I know four people in my circle who received positive decisions on their PRRA applications and obtained PRs for themselves and their families from back home. All of them were deemed ineligible for asylum due to their claims in the US and had waited in the US for seven years before coming to Canada. The problem with this friend is specifically how to obtain his brown paper ID. This is the exact issue we’re trying to resolve, but no one seems to have an answer.

How does in most cases mean that you are guaranteed PR if you get a positive PPRA?

Definitely it does mean guaranteed PR %100 , just because you are not happy with a huge numbers of approval and positive decision from refugee board, it doesn’t not effect any pR pathways soon or later we will all get PR and you just have sadness with mass immigration hhhhhh, sorry this is fact will not change easily and soon from the base to top so don’t care election come soon or not, that’s something different your comments and post can’t reduce number of positive decision from ircc and IRB even can’t reduce hope to get PR so it’s better shut up your mouth with zip tightly because new plan come out soon with approval half million hhhhh imagine how will effect your society and your culture we will fucked up entire your roots hhhh
