Hi All,

My mother has been staying with me(I am Canadian Citizen) in Canada since January 2019. Her visitor visa expired in 2021. She is on Visitor record and we extend her stay every 6 months. She has been getting extensions till now. Now we want to apply for supervisor. For that, she needs to be outside Canada.

  1. My mother is an Indian Citizen. Can we Apply for her super visa from the USA? (She has a valid visitor visa to the USA and we will send her to the USA and then apply for her Supervisa from there)
  2. Is it absolutely necessary to be in your home country to apply for Supervisa? CIC website only mentions that you must be outside Canada to apply for Supervisa but no mention of home country there.
Please help with the above questions.

She can apply from the US. She will have to wait there several months for a response if she doesn’t have a TRV. Like TRV, she will need to show ties to home country.

You can apply for her Super Visa online from Canada on her behalf. When filling out the forms assume your mom is applying online. During the application process you have to select her current residence country. If she has a visitor visa to USA, choose that and once her application is approved, she will get a notification to send her passport for stamping. She has to send her Indian passport for super visa stamping to an office in the USA. Once the super visa is issued, she has to return to Canada (from USA) on that visa.

So make sure your mom can travel and stay in the USA for the duration of the application process.
