Greetings everyone! I just recieved an email this morning from CIC stating that they "are NOT satisfied that my sponsor intends to reside in Canada." We have only 45 days to submitt any additional documents. Please let us know if you know what additional documents we need to satisfy them on the matter that my wife wants to reside in Canada.
I am a pakistani and my wife is a canadian. She is residing in South Korea with me at the moment and we are in the process of finishing her contract as an English teacher and we would like to return to Canada in March 2015 when her current contract is over.
When she applied for my sponsorship we included documents such as my wife's previous contract which dates March 2012-March 2013. We did not sent them her current contract becuase and that time we didnt know our immigration application would take this long. Along with her 2013 contract we also included her job searches in Ontario Canada that specifically shows her need to find a job when she returns to Canada. Her friends and family also submitted a letter that confirmed we will be returning to Canada and that they are waiting for our arrival. Most of all her family also submitted Letter of Garantee that confirms that when we return to Canada we will be staying in her parents' house and they will garantee the payment of our expenses and well being. However they are still NOT satisfied. I am thinking of submitting her current contract which dates march 2014-March 2015. If you have any advise on this matter and additional documents are need to satisfy CIC that my sponsor intends to reside in Canada please let me know.
HERE IS WHAT CIC WROTE IN THEIR EMAIL:
A sponsor who is a Canadian citizen and does not reside in Canada may sponsor an
application by their spouse, common-law partner, conjugal partner or dependent child if the
sponsor will reside in Canada when the applicant becomes a permanent resident.
Based on the documents you submitted, I am not satisfied that your sponsor intends to reside in Canada
once you obtain your status as a permanent resident.
If your sponsor can demonstrate that he will reside in Canada before or when you become a permanent
resident, it may be possible to proceed with your application.
Any evidence or submission which you or your sponsor may wish to provide must be received by this
office within forty-five (45) days from the date of this letter. If we have not received a response within
that time, your application will be assessed based on the information available on file, which may result in
a refusal.
Only original documents or, when unavailable, certified documents are acceptable.

I think the immigration officers who looked into your application was already expecting your wife to be in canada because you only showed her contract that expires in 2013. So maybe the best you could do is to show the immigration officer about her latest contract and an affidavit or letter indicating her intent to return to canada once she finished her latest contract of work and the reason why she renewed her contract for when you are actually processing your application for PR in canada. The officer might be thinking that your wife should have been back to canada and re - establishing herself again in her home country and preparing once you land there.

I think you have one big problem and that is wife's current contract doesn't end until almost a year from now, which doesn't show serious intent on leaving South Korea. I don't know why you submitted documents that show your wife's previous contract, becuase that only just shows she's very committed to working in south korea, as she has had many contracts working there already.

Showing job searches isn't enough, because any body can just type in a search and get results. A big help to her would be if she had a job offer from an employer. Even if she got refusal letters from prospective employers, that shows she's really serious in getting a job and settling in Canada.

She should also show a letter from her current boss saying that she will quit the company as soon as you get PR.

Yes i am also thing about that and i will do that.

Its very hard to find job if you are not in Canada.
And i thing it must be clear cic thsat she on working visa and her job contract will end on march 2013 on that time we were thining we will get my visa before march 2013 but we did not get so she renew her job contract for one year.

While you should immediately reply to this email, your wife should also consider obtaining her GCMS notes to see exactly why the visa officer has taken this view.

I've never ordered GCMS, so I can't really comment.

You don't have to use his free offer though (I'm not even sure if he still offers that free service, since his last login in this forum was in October 2013). You can order it yourself using the instructions provided in that thread. Actually you know what, I think it's your wife who's supposed to order, since she's the Canadian citizen...

As long as she lands in Canada before the expiry date of her COPR, she'll be fine. After her first landing (thus officially becoming PR) she can also go back to South Korea to complete her job contract, and then return to Canada.

So if we send manila her new job contract and there is a contract expairy is march 2015 so manila will not hold our case or what ?
Like they will see my wife job contract will end on march 2015 so how can she will come with me and she already mention in some application form that she will move to canada when she will get my husband PR .

We were thinking that we will get visa on april 2013 when her contract will end but we did not get any response from manila so she sign new contract as my application in process thats why but now Manila contact us.
