hi,
I did apply for common law sponsorship !
now I got an email that they want IMM5409 send by email I guess signed and filled out!
I thought I don't need to fill out this form IMM5409 Stat Dec of Common Law... I did ask in the forum?!?! :(

DO I have to send it also by mail or just email??? or both?

they send it all to Ottawa I thought they would send it to Vienna ... does it mean it will be done under one year? :) I hope so!
what can be the reason they send it to Ottawa and not to vienna ( I am from german).

DO I HAVE TO GO TO A NOTAR? to get it notarized???


I am the declarant? or my Canadian common law partner?

one Question is: how many years we are in conjugal relationship?
do they want to know the date we are in Common Law or since we are living together joint rent?

Usually the advice we give is to send in this form, even though technically you do not have to, because often the visa officer wants to see it - as they did in your case.
The email says to email them the form, so do that. You could mail it as well.
The sponsor is the declarant. You have to get it notarized (or a commissioner of oaths can sign it). Put the date you started living together - if you put the date one year after you started living together, and only lived together one year, this would make the 'living together' part 0, which is nonsensical. That is, you lived together for one year; after that one year, CIC recognized you as common-law partners. But for this form put the date you started living together.
No one is sure why they sometimes send the applications to be processed at Ottawa. In any case, Ottawa is a fast office.

You need to have the document notarized.

Since it will have original signatures, you should make a copy of it (to keep) and then mail the original to CIC. You should also submit a Case Specific Enquiry and attach a copy of the document as well.

The date that you entered into your Common-Law relationship, is one year AFTER the day you moved in together.

I really do not think that is what they are asking for on this particular form. Yes, in general, for sponsorship purposes, the date you become common-law is one year after you move in together. But for this form, it states: '... we have cohabited in a conjugal relationship for ____ years from ____ to ____.' If they want the date after one year, a couple who has lived together for exactly one year would then have to put '0 years' and from one day in, let's say, 2016 to the same day in 2016. This can't be correct. The couple becomes common-law after they live together for one year, but they are still living together for that first year. For this form, that is the date that should be put.

Correct. I was only stating when the C-L relationship would have actually started.

It doesn't really matter, but since you are the one that is applying for PR, wouldn't it make sense for you to be the declarant? ;)

IMM5409 is required, it's point 5 in the document checklist IMM5491E that you should have submitted with your application. We've done it the other day, takes 5 minutes at a notary and costs ~30$

Unless CIC has changed things, this is NOT required. It has always been optional, but I agree that it's not a bad idea to send it with the application...just in case.

We had the exact same thing - asked in the forum, and was told it was only for when a couple was sponsoring someone else, or something like that. Expected our file to go to Vienna, it's also in Ottawa and got the request just like you. Request came May 9, we made a Statutory declaration at the Canadian Consulate here and sent it off via email and then via hard copy in the mail to Ottawa, along with all kinds of more proof.
