Dear Friends,

I am writing below post with some pain and require you valuable suggestions.


Last July 2014 applied for Canada PR, received AOR # and Medicals completed for myself and my spouse, waiting for Passport request since 2 months. Everything was going fine but I am in a trouble now. Due to some differences if our married life, my wife is requesting for Divorce, I am not happy to inform that. I am trying my level best to over come this issue and settle down in my life with my wife. Friends / Mentor require few suggestions for my future.


1) If my wife is in interested in Divorce and we get separated, it will effect my PR( my wife never came to canada, but I was in and out of canada for couple of months).

2) If we are applying for Divorce(Out side canada, home country), if i get Divorce and maintain my PR status. If again, I get married Is there any chance to sponsor my second wife (If my current my wife does not land in canada and complete PR formalitys) or anytime period i need to wait.

3) Is it safest way to inform CIC and drop my Wife name from Process.( I am thinking if I get passport request, I will land has principal applicant and go back to my home country and convince her and later I can Sponsor her after solving our issue, I want to save my marriage).

Friends your valuable responses will help two people. Request to provide your guidance / comments

Since it sounds like you are not under family class (Canadian PR or citizen sponsoring spouse or parents), most of us won't be able to help you too much.

However, if you application is at a visa office, you would fax or email the visa office.

If you already have your landing papers, I would contact CIC and see how to proceed.


A note, If you drop her from your application she will be inelligable under family class aponsorship most likely. There is no jepordy for you to let her land, even if you divorce, since you are not a family class application you are not responsible for welfare or any other social assistance she may collect.

I would wait and see what happens. You can drop her at any point in the process. I believe if you land at the landing you may be able to drop her.

How did u apply for PR? Under which category? If you applied under skilled migrant or any point based program and you have been awarded points for your spouse to make you eligible for program, then divorce will result in cancellation of complete process which includes ur PR even if it is approved and U didn't land yet on PR status.

I think I have posted in wrong category but still you response will be helpful. I have applied under Canadian Experienced Class and waiting for Passport Request. Also, please confirm If my wife Divorce(Sin in my community to take this word, but it happen to me) me(and if she does not land or her landing VISA expires) and If i get married second time, can I sponsor my second wife anytime.

You can sponsor but this first marriage will be a red flag on your application and make sure you explain clearly on your sponsorship application about the situation.
 
Thanks. What type of difficulty's I may face in future? Could you please provide some details? I am still hopeful that my marriage with my wife will resolve.
 
You need to ask this question under Experience class . When we sponsor a wife or husband under family class, and the marriage fails we can not sponsor another wife/husband for 5 years from the date our husband / wife landed in Canada.
 
I know someone with similar experience.

My advice to you:

1- You should inform your visa office once there is a change in your marital status "Separation, or divorce" happens in your life. No need to inform them before that.
2- If you are the main applicant, No worries about sponsoring your new wife when you get married. All what you need is to submit all of your documents to CIC when you apply for sponsoring your new wife.
3- If the separation/divorce happens after you both got the visa, I advice you to inform the visa office too with this change.
4- If the separation/divorce happens after both of you have landed to Canada. The only place to inform will be CRA "Tax Organization".

To clarify, it is only the sponsored person that is subject to the 5 year bar.

If a relationship fails, the sponsor could immediately sponsor another spouse. It's a red flag and there would be extra scrutiny but there is no bar against it.
