We had done our landing on 10th Mar 2010, post we returned back to dubai. We received our PR cards with the exception for my youngest daughter where the requirement was to submit a revised photo and is required to apply for a PRTD from the Canadian embassy in abu dhabi. My spouse, eldest daughter and me have the PR cards valid upto 31st Mar 2015.

Can I apply for a PRTD for my daughter at a abu dhabi embassy.
Will we be allowed to enter the country (toronto) given that we will not exit Canada for good.

Appreciate your views and advice.

As a PR, you must reside in Canada at least 730 days (2 years) in any rolling 5 year period in order to keep your PR status.

When you apply for a PR TD for your daughter, it is possible that it will be refused based on that she doesn't meet the residency obligation. You can enter Canada with your still valid PR card but it is possible that you will be reported on entry. If that happens, you may be given a choice to renounce your PR or you could be reported in which case you would have to appeal if you want to keep your PR. However, you will not win an appeal if you did not have humanitarian grounds for not being able to meet the RO.

What is your plan?

In that case, I do not have a choice but to surrender the PR cards & reapply again.
Is there any other alternative.

If you have humanitarian grounds for having stayed out of Canada, you could apply based on that. If you stayed outside because of a good job, financial reasons etc., you don't really have a chance. If you didn't have the issue with the daughter without PR card, you could have tried your luck if you could enter Canada without getting reported in which case, you could have stayed for 2 years straight in order to revive your PR status but the daughter without a card kind of makes that impossible.

My wife was not well and was undergoing treatment in mumbai, India. my wife has passed away on 10th June 2016 due to her illness. my wife family I.e her sister and brother and their families are in Canada and we do not my wife family in mumbai

Wanted to know whether
1. is it possible to re-iinstate the PR cards and how
2. Or should we apply as PRTD along with the hospital issued death certificate And burial certificate.

Application for new PR cards need to be made from within Canada. Thus, you need to travel to and be in Canada before you can apply for new PR cards.

If you apply for a PR Travel Document, obviously you will need to make a strong H&C case. Otherwise the PR TD is likely to be denied and your PR status lost. (You may appeal, but again the outcome will probably depend on the strength of the H&C case you make; if you appeal and lose, that will mean PR status is lost.)

To make a persuasive H&C case will require significantly more, actually probably a lot more, information and documentation than the death and burial certificate. Obtaining the assistance of a reputable Canadian lawyer experienced in immigration law would be prudent.

Note: this subject would be more appropriately discussed in the conference for Permanent Residents, and might elicit more responsive observations there.

We are based in Dubai (Currently in Mumbai due to paper work to be completed). Should I write an email to Abu Dhabi Canadian Consulate or should I submit the PRTD forms for my children and myself given the required justification.

I applied the PRTD on H&C & I and my kids have just received the PRTD visa with an expiry of 23rd Apr 2017.
Just need to know the following as we plan to migrate to canada in the month of March 2017:
1. Can I move my household stuff/ furniture etc via Cargo to Toronto - Will I be taxed if I cargo to Toronto.
2. Can I carry with me a draft chq which I can open an account in Toronto and deposit the card - Will I be taxed for the funds which I bring in
3. Can I carry Gold with me of my late wife and Kids with me when we migrate - Will I be taxed for this as well.

For all the above 3 items - What is the procedure to be followed at customs in toronto.

Congrats on your PRTD! Did you declare your household items on your first landing? If not, i think they will cause you trouble. Remember the embassy issues visas where entry is not guaranteed! Entry depends on how satisfied the border agent is. As for the draft cheque, you should be ok, just make sure you declare it. Now for gold, i am not sure...may be someone may have an idea. I suggest you declare it and all the money (draft chq and cash). Good luck

Only landing time you had chance to bring whatever you want or declare what you will bring within two year of periods.

After that each person or family is allowed household stuff up to $2000 only.

No difference between cargo or checked in luggage this is your choice how to bring duty will be same.

Draft or cash up to Canadian 10000$ only.

For Gold ornaments if reasonable value normally they don't create problems but if you have more gold than there will be duty.

I think you can bring in any amount of cash as long as you declare it AND of course explain the source IF it's a large amount. Otherwise any amount less than CD$10,000 you are not required to declare...
