Hi,

I had gotten my PR on June 2014 and had the Condition 51. My marriage broke down before two year period because of my abusive partner but I did not report her and just left the country. My ex-wife did not report the divorce to CIC either and I think my Conditional PR changed to Permanent PR after two years.

My question is, with the new law passed today that gets rid of the two year requirement, can I return to Canada given that my marriage dissolved before the new law came into action? I know I need to maintain the 2 year residency requirement, which I still have time for.

According to CIC website: Effective today, conditional permanent residence no longer applies to anyone, whether:

you were sponsored by your spouse or partner for permanent residence, or
you were sponsored by someone who had conditional permanent residence (i.e. child or parent).
You don’t need to do anything. We just want you to know.

If you receive your Confirmation of Permanent Residence on or after April 18, 2017 and it indicates that you “must cohabit in a conjugal relationship with your sponsor or partner for a continuous period of 2 years after the day on which you became a PR”, this requirement no longer applies to you.

If you were under investigation for not complying with the requirement to live with your spouse or partner, you are no longer under investigation.
 
thank you for your response. It has been a year and few months since I separated from my wife. If I update my CIC status to divorced now, even though I got it a year ago, can my PR be revoked on the grounds that I have I didn't inform CIC in change of marital status as soon as it happened?

You don't need to update IRCC on your marital status.
 
so is it safe to assume that with the new law taking effect retrospectively that I am a PR given that I maintain my 2 year residency requirement? (even though I was seperated from my wife)

yes...you no longer need to stay with your spouse
