Hi Guys,

I am on a closed work permit since October 2011. I quit my job in Dec, 2011 due to some reason and applied for federal skilled worker category. Last year i.e June 2012, I found one employer who applied LMO for me and my consultant advised me to take pay cheque from him. I took one pay cheque without LMO approval. Now, my LMO got rejected twice and I got T4 from my employer who applied for my LMO. I was unauthorised to work under any employer but still i got one pay cheque. I am worried now what will I explain to CIC if they ask me NOA for year 2012. Recently, I applied for CEC as well. Please guys suggest me what could be done in this situation?
 
Did you declare the unauthorized work in your CEC application?
 
No, i did not. I just got T4 from him for one cheque. i dont know what reason I should give if CIC ask me for notice of assessment and they will see some income on that. Technically, I am not suppose to work under any employer.

By the way, I applied under CEC for the work experience I gained from sep 2010 - sep 2011.
 
So to recap: -

1) You have completed unauthorized work in Canada.
2) You have misrepresented yourself by concealing the period of unauthorized work in Canada in your immigration application.

If they request the NOA and question it, you are pretty much a lost case. You best hope they don't request it.
 
I hope they dont ask but if they ask then is there anything I can do? I paid my greedy consultant so much and she advised me to take cheque even when LMO was in process :(

I wish I could say something different but I really can't. It's not even just the unauthorized work experience, you have lied about it by not providing the details on your application which will be deemed to be misrepresentation. If they find out, you will be banned for Canada for at least 2 years.

Did you provide the 2011 NOA? If so, it is unlikely they will request the 2012 but it's possible.

Everyone else needs to take note, do not take advice from crooked consultants... It's not worth it.
 
Yes, I did provide the T4 and NOA for 2011 which was absolutely correct. The only mistake I did was, took one monthly pay cheque (2012) from the employer which was technically wrong.

Anybody else who faced this situation please reply. I need to get solution for this problem :(. One thing i wish to know that does CIC have any contact with CRA? I mean CIC can ask documents from applicant only but do they have authorization to verify anything related to income and tax from CRA?

But you have already applied (CEC) with your latest NOA at that time which was the 2011 NOA, correct?

Why would they come looking for your 2012 NOA?
 
I hope they dont ask me 2012 NOA but just to be on safer side, i want to get prepared for the worst situation. The experience on which i applied my CEC application is based on 2010 and 2011 NOA which i provided with the application. Just worried about if they ask me about my current situation (unemployed and unauthorised work exp in 2012) :o

They won't care what the consultant told you. You're obviously familiar with the work permit/LMO process, so you should've known not to work for anyone without proper authorization.

Your best hope is CIC doesn't ask for additional documents. But why have you waited to apply for CEC for so long?
 
Coz I only have 15 months of skilled work experience and rules have changed in this Jan. So, I planned to apply for CEC. BTW, i have applied for federal skilled worker catergory as well in October, 2011. It is taking too long these days :(

Doubt they will ask you for the 2012 NOA.

Also, if it was only one cheque - get the employer that gave you that one cheque to write a letter saying it was a bonus from the time you were legit or write your own letter saying it was a bonus from previous months.
 
Yeah, thats a good idea that I can show that income or cheque as bonus I got for the service I provided them in the previous year. Thanks for the great advice :)
