Hello all.

I got a big issue on my hand. My wife started her application for international student visa.

Now the problem is that we applied mid-March, her studies begin 10th of May, and our flighting tickets are bought to 26th of April... IN 2 WEEKS :( (I bought the tickets ending of December, thinking we would start her application way earlier than it did)

I saw the processing time for our visa, and it says 9 weeks, surpassing the time for our flight AND the start of her studies. However the college said they will accept her to start with a late entry fee by 29th of May (More than enough time for those "9 weeks" predicted)

We would not like to loose our flight at least, because that would be extremely costly.

We both have Tourist Visas, can we fly to Canada with all our stuff, while her application is still running? That way we would only have to send our passports to my country VAC by Fedex, and they would stamp it with the Student / Worker visa and send it back to my parents home. My parents would then send it to us by Fedex to Canada.

Meanwhile we would try to find somewhere for a long term rent while we wait for our respective visas to start her studies and then to find work for me.

IS that possible/ethical/feasible/crazy?

Thank you all.

Important note I found in CIC's Website:

http://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=1018&top=16

I know that Student Visa is not equal to Permanent Residence, however it shows that those who have other ways to enter Canada, are not forbidden to enter. The problem on my mind now is when we do get accepted for student visa, how are we going to get our student/worker stamps?

Thank you all.

Hi

You can travel to Canada; there is nothing wrong with coming here as visitors while another app is processing. You likely would not have problems entering as visitors but remember that entry is entirely up to the CBSA officer at the POE.

Once your study/work permits are approved, you would need to actually leave Canada and re-enter to activate them. You can flagpole at the Canada-US border.

OK great... understood about the flagpole between Canada and US Border. However, how would I be able to get the stamps on our passports? If her student visa is accepted, and my work permit is accepted, how are we going to get our passports stamped?

We started our process while living here in Brazil, however we started the process ONLINE.

Leave and re-enter Canada is an easy step :). My biggest concern is to get our visas stamped in our passports after the acceptance.

Thank you!

Just had a quick look at your previous responses. I would be concerned about you, your wife or both being denied because your proof of funds was pretty low especially for the both of you. You also have clearly been trying to immigrate so your profile will be scrutinized to make sure your wife is a true student and that her studies make sense. They would do that anyways but expect extra scrutiny. I would not sign a longterm lease until you know whether you are granted visas.

Thank you for your concern Canuck. We are indeed trying to immigrate, however being totally honest about the dual intent. We are even going to place all the cards on the table with the border officer, express entry #, her study and my work permit application. That does not mean I will stay illegally nor work illegally in Canada. I believe the border control might see our honesty and see it better than us trying to hide our dual intent.

Her studies are rock solid true, she is even a transfer student from a prestigied public university here in Brazil (Universidade Federal do Rio de Janeiro). She is on her third semester already.

About the pof, we sold her car we were unwilling to sell, like I said before (she wanted to give to her father, but that is another story) and few other things; We are both confortable now above more than enough for her tuition + 14.000(us both).

I wanted to ask you guys two last questions:

. Can I change the VAC stamp to Canada? That way I dont need to courrier our passports.
. In case we do courier our passports, can we be in danger of walking in Canada without passports? (Do we need to bear passport at all times?)

Thank you all
