Hi

I am a PR in Toronto since mar 2011 from New Delhi,India.
My fiancee and I have been dating since the past 7 years and in Dec 2013 we got formally engaged in New Delhi.
I am getting married, november 2014 in Delhi.
My fiancee is in China on work visa for May-October 2014. He will stay in India after October.

My question:
Should he apply for visitor visa from China and then he can accompany me here after the wedding. And then apply for his pr within Canada
OR
I should return to Canada alone and apply for his PR while he waits in India.

Which is better?
Success rates? will he get travel visa easily?
will he need invitation letter?
will they cause problems and ask questions like: you knew you were goin to get married,why did you apply for visitor visa? will it cause problems later?

Any advise will be great! Please Help! and thanks :)

You can always try to get a visitor visa for your fiancé. It can be quite difficult. Probably a better chance if your try for the visitor visa before getting married, but still difficult.

You can have your spouse return to Canada with you, if he gets a visitor visa, and still apply Outland through India. You can send him an invite letter, but when they know you are in a serious committed relationship, it will seriously decrease the chance of getting he visitor visa, unless your spouse can prove that he has strong ties to India.

Of course, if he gets the visitor visa then you can come to Canada and apply Inland, but that takes a really long time. The only thing about Outland sponsorship through India, I understand that India asks for the passports early and so your spouse will be without a passport for a few months... Also, I recall reading before that India doesn't allow your passports to be mailed from Internationally, so that could pose a problem as well, if your spouse has a visitor visa and is in Canada when the passport is requested...

You should go to the New Delhi board and ask some specific questions in there because they will have a better idea about the specific intricacies of the New Delhi office.

So if I understand correctly, If somehow he is able to get a visitor visa,can he visit me here, apply outland and then return in time to hand over passports in India(i didn't know that!) I thought you had to stay in the country of application the whole time...

Also is letter of invitation really necessary? do we have to show them we are in a realtionship for visitor visa purposes?
Can he say he's visiting for checking out colleges+travelling?

The trouble free option is:

Get married in India and bring the certificate attested/certified and translated if not in English.
Get all the paper works for sponsorship done - means collect papers required from spouse.
You return to Canada and submit sponsorship application as soon as possible.
Let your spouse wait in India and his PR application in Family class- spouse will be done at New Delhi.
Let him land in Canada as a PR.This method is easy, very safe and tension free for both. Not too much waiting. Check the spouse processing time of New Delhi.

Coming to Canada as visitor and applying inland will make the process more delayed and both should anticipate the unforeseen problems.

I know they usually ask for a letter of invitation. I don't know if it is actually necessary. It will be hard for him to visitor visa because if/when they learn of your relationship, it is hard for the border agency to believe he will leave when his visit is expired.

He could say he is looking at schools and universities, but I would only say that if it was true. I wouldn't want to blatantly lie on the application, but if his primary reason for visiting is not to see you, then that might bode better.

Yes, if he applies Outland and has a visitor visa, he doesn't have to stay the whole time in India. He will have to be sure that he won't have any trouble with his passport. India does things a little differences, so if he gets the visitor visa, find out about e little intricacies of passport request, etc. And it should be fine.

The hardest part will be getting the visitor visa. But if he has strong ties to India, money in his bank account over a longer span of time, and a lot of travel history, it might be a little easier for him to get.

yes, outland applicants can be in canada as a visitor, student or worker during the processing. many people do this very successfully, and extend their stay to get through the processing. the only risk is if an interview is called, then the applicant would need to return to their home country to attend.

to get around the international delivery of the passport, what people do is give an address of a family member in their home country, then have the family member send it to the applicant in canada, where they can go to a land border and "land" as a pr.

since you are a PR, you will be required to remain in canada during the entire processing of the application, so you will not be able to go to your spouses coutry and wait with them there. i belive short trips are ok, just not long term visits.

The sole purpose is to meet me, we have been doing the long distance thing for 3 years and didn't want to wait any longer...
We both are still quite young so as far as alot of money in banks is concerned :) that might be an issue!

So I guess,visitor visa is out!
I will sit down and put together a solid application-and pray for a speedy visa!!

LAST QUESTION:
If he does try for a visitor visa through China,just try and gets refused, will that effect our pr application later?

If he only has that one refusal it shouldn't pose a problem. It is only natural to want to visit your significant other! If he had a ton of refusals that might raise more eyebrows.

My husband had one successful visitor visa (when I was living in his country) and one visitor visa denial (I was still living in his country... I don't get it) and we didn't have any problems. He was approved in 3 months, including the sponsor approval, so it shouldn't be too much of a question if it is e only refusal he has. Make sure you list it and explain it on the PR application forms. There is a spot for this.
