Hi - There is no way to know. When a bill receives royal ascent and becomes law, it will be sent back to the government who will have full discretion on its implementation. The government can choose to implement the pre-PR period right away or can choose to delay it by a certain period of time that is judged to be necessary. The best example on this is bill C-24, the 4/6 article did not get implemented till a year after the bill received royal ascent. This timeline was then approved by Jason Alexandre (minister of immigration) and Stephen Harper.

I am not sure but the I also heard that the government has up to a year to actually implement a law that has received royal ascent. So long story short, you can't know exactly how a law will be implemented once it received royal ascent. We can only hope that it will be in the benefit of all

They seem to drag and drag bill C-6 as intended before!

To make your statements more accurate:

When a bill receives royal assent, it becomes law. The coming into force of a law cannot be delayed unless it is specifically mentioned in the text of the law. In Bill C-6, the coming into force of certain sections, including section 7 which alters the way the residency requirements are applied, will occur on a day that will be set by order of the Governor-in-Council. Certain provisions of the bill, for instance those that repeal the Minister’s power of revocation of citizenship for certain convicts, do not require Order-in-council and will come into force immediately. The Governor General issues Orders-in-council on the advice of his government, in this case, his minister. Practically, this allows the Department of IRCC to pick the date as they see fit. On April 12, 2016, the former minister was asked about the coming into force timeframe. He responded that the residency requirements will be implemented with “some delay” to prevent a potential backlog. He did not specify whether it would be a couple months…. or a year. Meanwhile the Department will have to perform a public consultation on the amendments to the citizenship “regulations” to comply with the new law. Once they are gazetted, they announce the date on which the new regulations will be applied.

Now, I am planning to apply for Citizenship but on Citizenship Application form CIT 002 Section J(Income Tax Information), I am required to check 4 taxation years prior to my application.
I filled tax return for 2013, 2014 and 2015 while I am yet to receive T4 form for 2016 taxation year.

Is there any implication if I send my application before I am able to file tax return for 2016.

Hi Orire - You need to send proof of the fourth year. So you might not have the notice of assessment but if you have the fillings that would work. It is highly not recommended that you send your application without the required documents otherwise it will be returned to you

My situation is little different and need help on understanding.

I landed in Oct 2011 than went back after 45 days.

Came back on Aug 2013 until today.

As per new rules i will be eligible in Nov-2017.

I filled tax right from 2011 until 2016(pending).

In 2013 i stayed less than 182 days.

When i should be eligible for it as per new rules ? Nov 2017 or after i file my tax for 2017 ( Feb/March 2018) ?

Please help me on understanding it.
