Tourist Visa for Wife or Sponsor first - What red flag should I look for?

Hi

Need some advice. I recently got re-married to my wife in our home country in South Asia. Our relationship has been for over 3 years and got married 1.5 year now. I have two kids from my previous marriage in Canada (I got married to my 1st wife in Canada and we both were citizen).

One of the reason why I did not sponsor my new wife to Canada is because of her career and my current situation with business which is starting to pickup again. She is 23 years old and has a promising acting career. She is currently a model (starting). So after getting married, we agreed that she will stay there for few years and try to focus on her modeling/acting career . She has become quite famous in film industry although yet to receive a role in future film. There was a film where she was selected as a actress but due to financial reason that film never took off. But she does have a written agreement

The main reason I did not want her to come to Canada yet, was that I wanted her to focus on her career ad try to establish something for her self before committing a life in Canada where I am certain she will have to reset her life of settling to a new country. I did not want her to blame me for not giving her that opportunity of able to be something for her self. I do visit her almost every 2 month and we go on vacation every time to neighboring country like India, Singapore, Thailand etc. At the same time, this give me some free time in Canada to spend with two of my kids who are still very young and focus on my business

Since I travel every 2 month to Middle East/Asia for my business, my wife often join me on those trip or I visit her after my business trip. Now I wish to bring her to Canada for few weeks so she can visit with me and then may be after 1 week or 3 weeks go back with me again when I go for my next trip. I don't have any plan to sponsor her as a spouse until she feel that acting career might not happen and/or she is ready to settle in Canada for good.

What would be some of the red flag I should look for? Since it is 2nd marriage for both of us, we did not notify the family at first nor there was a ceremony. We got married quietly however, both family knows about it now. I send her money every month via western union and we have all the receipts, she even have a supplementary credit card from my USA Business thus, she use that for her daily expense. We also have small piece of land together in back home.

I am also seeking to hire a lawyer, for legal advice in this matter

She was 21 and when she started her second marriage? Was she still married when you started your relationship? From your post, I have a sense that you are somewhat older than her. This is generally a red flag that has a higher level of scrutiny.

Anyway, you would have at least had a Civil Ceremony? Any pictures of the signing day would count. Generally, you just need to provide the best evidence you can and explain why things are atypical.

Hello Faisal, I believe in one of your prior posts you indicated that it would already be hard to get your wife a visitor visa - called a TRV - temporary resident visa - as it sounds like she is from a non-visa exempt country. Now that you are married it will likely be refused, there are lots of people on the forum who have tried this and most of the time immigration refuses them because they think the spouse will not leave. My husband and I were refused 4 times :mad:. Anyway here is what I recommend for your situation.

Apply to sponsor her and be prepared to explain why you waited to submit an application. Sometimes immigration will wonder why people wait after they get married as many couples are so eager to get in the queue as soon as they marry. Your reasons may all be valid, you will just need to explain them in detail.

It may be a long process so I would start preparing to apply now, if you do a really sound application it can take several months simply to gather all of the necessary proof/paperwork. Save every receipt, money transfer, travel document, e-mail, SKYPE, chat or facetime, whatsapp logs, any single thing that shows the trajectory of your relationship from the very beginning. Include photos and there will also be a list of needed items in the guide specific to your wife's country of birth. Err on the side of "over-explaining" and try to view your application like an immigration officer. Guilty until proven innocent and it is your job to convince them that your marriage is genuine. I suggest you start now as there is always a possibility for all of us to be refused and if that happens then you need to be prepared to go though an appeal process which is also lengthy. All of this costs time, money and energy and it is better to start now and go through the already complicated process then wait for more changes to happen with immigration that could potentially be negative. Also Mapleson was correct in that if there is a large age difference be prepared for closer scrutiny.

Thanks for your reply. I never applied for any Visa or any sort yet. I did inquiry about applying her as a common law but that was before marriage. Her first marriage was when she was 18 and but they got divorced within 5 months. I met her right after her divorce. We started dating and got married ever almost 3 years. Met on 2009 Oct 2 and got married Jun 2013.

There are few reason why I did not apply for sponsorship and we both agreed.

a) -She is pursuing an acting career in South East asia. I wanted her to try her best to see if she can accomplish something in her chosen career before making a big decission of settling in Canada so atleat she can say she tried. She is getting lots of notice in film industry though process is very slow and cumbersom, she has yet to land something good. But we are both optimistic that she will get some where and I am financing all her modeling, port folio, I am advertising her facebook page which Facebook is charging me on my US account.
b) - 2nd I have to financially support her family (member of 5 total) because her father left them in no situation all of suddent for another women and there is no child support concept in asia. 4 girls and one small brother, she does not have any other option to earn enough yet but to rely on me. So I decided to take on that responsility of financial supporting her family. It has been extremely hard but no other option. If she were to come to Canada and settle with me, then my financial contribution will double as I may still have to support her family until she gets a job in Canada and still support her expense while in Canada. So financially it is cheaper for me to have her stay there while she pursue her career and I try to stabalize my business (which is still shaky)
c) - I have two small kids with my Ex-wife. Currently I have unlimited access therefore I go when ever I want and see them when ever I want so I can devote all my time while in Canada with my kids
d) - i visit asia every 1 to 2 month for my business thus I get to visit my wife there and take her with me so I figure, we both take this opportunity where she focus on her career, i focus on my time with my kids and still be with each other.
e) we are on skype almost 8 to 12 hours every day (have logs). I call her using long distanc carier and spent $15 almost every day which I also have statement to proof. I pay for all their telephone bills I have all the receipts to proof that as well for last 3 years
f) I have all the money transfer reciept for last 3 years
g) we have purchase a piece of land together in our home country where both of our names are there and it has been almost 2 years now

we have over 1000 pictures of us visiting Asian country where she does not need Visa including her family
Last month we did visit my side of the family and they did a small gathering of ring ceramoney and have pictures as well

When I saw the sponsorship process it shows 31 months. I understand when couple get married they wanted to be togher right away well in my case, its a long distance relationship where I visit her almost every 1 to 2 month and I stay there any where from 15 days to 30 days at a time so it is not a quick visit or something.

You are welcome and it is very kind of you to be so generous to your wife and her family. I hope it is financially sustainable for all of you over the long term. When and if you do decide to sponsor it sounds like you have a lot of good proof to do a complete application. So keep everything organized now and it will serve you well when you put together your application. I would just point out that 31 months is a long time (almost 3 years) and I do not think processing times will decrease in the future they tend to increase.

There is no harm in trying for a TRV, immigration does not hold it against you. Just be prepared that it will likely be refused unless you have a very compelling case for your wife to return to her country and it is well documented. Immigration likes to see that the person has travelled outside of their home country (which she has) they like to see assets like property (also which you both co-own) lots of money in her bank account, preferable a job that she has been doing for several years that will keep her returning etc. I wish you and your wife the best.
