So you're basically saying the following:

Someone is currenly in Canada and has only lived in Canada for approximately 530 days out of the last year. They are planning on submitting a PR renewal application and plan to lie on the application and claim 740 days in Canada. On top of that, they plan to request expedited processing. If that summary is correct - I think that person is setting themselves up for huge problems and a long processing time. Lying to CIC is always a very bad idea.

That person should remain in Canada until they really have at least 730 days of residency and then submit the renewal application.

If they have to leave now, they should go and then hope they can obtain a travel document on compassionate basis (i.e. by providing proof the had to take care of an immediate relative who was sick and were unable to fulfill the 730 day residency requirement).

Ok I was short I guess 2 months or less, physically present in canada fully established I mean on job n everything. My whole case is on forum I applied for sponsorship fror my spouse n son. During the process cic issued rq. N thank God I didn't lie about anything to them previously so have been through an interview so now pr status is not inadmissible or,got approved still waiting,for renewal which will take sometime. But don't even think about lying to cic n then getting away with it nowadays, due to citizenship fraud cases,they are extra carefull so first of all don't apply for renewal before 730 days n don't hide anything as in long run it's n good for your status in canada. best of luck

huge problems = PR status revoked by CIC for failing to meet residency requirements

Tell your friend to look at the declaration section of the PR Card application form where it states "I understand that any false statements or concealment of a material fact may be grounds for my prosecution or removal"...if that still doesn't convince them then they can always refer to the Immigration and Refugee Protection Act (IRPA)


127. No person shall knowingly

(a) directly or indirectly misrepresent or withhold material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;


(b) communicate, directly or indirectly, by any means, false or misleading information or declarations with intent to induce or deter immigration to Canada; or


(c) refuse to be sworn or to affirm or declare, as the case may be, or to answer a question put to the person at an examination or at a proceeding held under this Act.


Marginal note:penalties

128. A person who contravenes a provision of section 126 or 127 is guilty of an offence and liable

(a) on conviction on indictment, to a fine of not more than $100,000 or to imprisonment for a term of not more than five years, or to both; or


(b) on summary conviction, to a fine of not more than $50,000 or to imprisonment for a term of not more than two years, or to both.
