We are deeply saddened by unexpected result of our application for Immigrant Visa. My better half stayed in Edmonton for 3 years, he applied as Immigrant under Federal Skilled Worker supported by his Employer thru established Immigration Consulting Firm based in Los Angeles. We are very grateful that this immigration consulting firm Okayed our application. Process has done (IELTS, passed points, medical, proof of funds). We are almost at the finish line waiting for the request of our passport for visa stamping.
Based on our timeline, our visa will arrived on 4th Quarter of 2012. We do the constant follow up with this immigration consulting firm on a weekly basis. Month of January 2013, my better half sent a letter to immigration office and after a week we received an alarming response. We are rejected due to: He does not meet the minimum requirements of the skilled worker class because he does not appear to have sufficient settlement of funds. OUR RESPONSE: we submit more than $13,837, more than the amount of requirements.
We addressed immediately the refusal letter to the immigration consulting firm and told us that they are also surprised for the Immigration Officer judgement. Said that they always do the follow up but no response from the Immigration Office and why the Immigration Office directly emailed a response from us, it should be via immigration consulting firm first. Also the decision was dated October 2012. The Immigration Consulting Firm agreed to us told us that there’s no reason to be refused because we followed their requirements. Representative of consulting firm narrated to us that the Immigration Officer might read the inappropriate policy. Our application covered the 2010 policy; Immigration Officer might have checked the 2012 policy. Appeal letter from the Immigration Consulting Firm was sent January 2013 requesting for a review on their decision, and confirm that we are indeed qualify for Canadian Permanent Residency under the Federal Skilled Worker Category. May I ask how long the waiting period?
Please help. I am just protesting for an unjust decision.
