Does CIO has the prerogative to send my file nearest to my residence country even if I did mention on the application that I want it to be processed by Manila VO? The problem with Manila VO is they don't usually respond to email inquiry as per the experience of others. I don't want my file to stagnate in Abu Dhabi office as they have very long processing times and It's not also good to find out that my file is with them after...say 2 to 3 months of waiting. I did send an email inquiry to CIO as to where they have sent my file just a while ago and I hope to receive a reply. Do you think I should send an inquiry to Abu Dhabi VO as well? I know that I cannot do much but to WAIT but as the saying goes... "Things may come to those who WAIT but only those things left but those who hustle". ;D ;D
If your application has not been sent to a VO for processing, ADVO nor CEM will have no records of your application yet. This may be a reason why no replies have been received back from your inquiries.
As to the office to which your file will be processed - it will be as per OP 1 based on IPRA regulations R11 for processing applications (excerpts
OP 1:
Permanent resident applicants – Family and economic (federal skilled workers, Quebec skilled workers, provincial nominees and business classes):
R11(1) requires that all applicants for permanent residence (other than applicants who come under Part 8 of the Regulations – Convention Refugees Abroad and Humanitarian Protected Persons Abroad) must submit their applications to the visa office responsible for:
• the country where the applicant is residing, if the applicant has been lawfully admitted to that country for at least one year; or
• the applicant's country of nationality, or if the applicant is stateless, their country of habitual residence other than a country where they are residing without having been lawfully admitted.
Depending on your application (i.e. as I see it - dependents in the PH? or dependents in AD?) - your file will be remanded to the VO best suited to process and evaluate your application. If most of your dependents included in your application is in the PH, most likely CEM will be the VO best suited to process your application.
Should your file be sent to ADVO, at this early stage, - there exists a possibility to request ADVO to transfer your file/processing of your file to CEM, again citing "program integrity" under OP 5.19 excerpts below:
Visa offices are not required to transfer applications for permanent or temporary residence to Canada upon the request of applicants or their designated representatives. Visa offices should transfer files only if that transfer would enhance program integrity. Conversely, visa offices should refuse to transfer files if such a transfer diminishes program integrity. Officers should consider consulting potential receiving visa offices to seek assistance in finalizing cases before transferring a file.
The onus is on the applicant to demonstrate that the transfer of their file would not compromise the integrity of the application evaluation process.
Program integrity includes issues such as ability to effectively evaluate documents; knowledge of local security and criminality environments; or familiarity with business practices and procedures. Other factors may be taken into account when evaluating the impact of a file transfer on the program integrity of visa programs.
As part of program integrity considerations, officers should also be mindful that the intent of R11 is to ensure that, as much as possible, visa applications are reviewed by the offices with the local knowledge and expertise necessary to conduct an effective case review.
I have highlighted sections which may benefit you should it come to a point wherein you would want to request file transfer to CEM. Note that circumstances should be presented to show adequately, that CEM is the best VO suited to process your application (i.e. IMHO to evaluate your dependents information in the PH
). My advise when doing this - do not cite the length of the application processing times as the reason, as it becomes then an applicant's preference for convenience and not due to "program integrity" reasons.
