Hi Gurus in this forum,

Help needed urgently..
Please share your precious inputs if you have knowledge about any situation of this type in past.
I am interested to know timeline for a CEC case which is agreed by CIC to be reconsidered by a different visa officer after keeping aside their earlier refusal decision. Below are details of my case:

Category: CEC
Application filed: Jan 2013
First AOR: Feb 2013
RPRF and Med's Request: Nov-2013
RPRF and Med's completed: Mid Nov-2013
Ecas Status changed to Decision made: Nov-25-2013
Case refused email by end of Nov-2013

It was hard to digest for me that my very genuine case was refused as VO was not satisfied with the duties mentioned in my reference letters to be sufficient for the NOC claimed. I live in US now and so no other option for me to re-apply in same category. As No opportunity for clarifications was provided to me by VO, I chose to challenge this decision in court with help of Canadian immigration lawyer in early Dec 2013. GCMS notes requested from CIC, got them in Jan-2013 and my lawyer was confident that the points mentioned by VO to refuse my application were errors related to proceedural fairness. JR filed Feb-2014. End of Mar-2014 - CIC lawyer asked my lawyer that if we discontinue our case, then CIC will reconsider my case and give it to another visa officer by keeping aside the earlier refusal decision.
We have now discontinued our case as the final outcome by court's decision would possibly have been the same(but after wait of .. you never know .. many more months from now).

Now, I am interested to know that what would be timeline for my case as it gets re-considered.
Ecas status is still decision made (but hoping it will change to in progress after above settlement).

Only reason why I want to know this is becuase my Indian passport is expiring in July end 2014. Due to various other travel reasons since past few months, I was not able to apply for renewal of my passport till now. And renewing it now from the applicable consulate in USA shows an estimated time of around 6 to 8 weeks. So, I have this big question in front of me - whether should I apply for my passport renewal right away, or wait for CIC to respond if they respond quickly in such cases.
Clearly, if CIC is going to take few months before they re-open my file, then it is makes sense to apply for renewal of my passport right away now, but as I am not sure of CIC timelines in these type of cases, I want to check with Gurus in this forum first before I proceed further on any step.
 
Are you sure thats the reason for your denial or because you are medically inadmissible. Something about your case isnt right
 
I have a copy of the GCMS notes from CIC for my case and it is 100% confirmed that medical results are good. So, medical is not at all a part of the earlier decision for denial.
 
Rejected after medicals? Wow....I've never heard that before. What does your GCMS notes say in relation to your rejection?

Chances of getting refused seems come at any place in Canada Immigration process these days..
Please search on this forum for same.. and you can also google to see many cases of refusals after medicals..

My GCMS notes clearly states that VO was not satisfied with the duties mentioned in my reference letters to be sufficient for the NOC claimed. But myself and my lawyer are confident that reference letter job duties are very very good match for the NOC claimed. My case might be somewhat exceptional but Nonetheless... for my case, there were errors made in refusal decision by VO and that is why I am able to fight back to this stage.

This is pretty shocking and the vo is so inconsiderate!!! MR is not guarantee of the pr, but it is so so rare to get rejected after RFPR. What is your NOC?

I have 2 years experience in this NOC, although the requirement was only 1 year to file for this PR application.

Any suggestions pls on what timelines can I expect now after CIC agreed to this reconsideration?

It is shocking. It is very frustrating they refused after medical and RPRF.
Good thing is that they are ready to reconsider your case.

If you dont mind, Can you please copy paste content from GCMS note where VO said he was not satisfied. Your file was reviews by two VOs or same VO refused ur file?

I think it's clear from people's reactions to this that not many are going to be able to help you with a timeline.
I would recommend speaking to your lawyer and getting advice on what you should do with your passport.

The GCMS notes copy/paste thing would be too much of detail and have lot of personal info, so I would like to keep it a summary of main issue only which I have mentioned above already.
 
I got my Canada PR in Jan, 2015.

Below is the revised timeline:

File re-opened (ecas showed in process again): July, 2014
CIC requested fresh/new Medical exams : Sep end, 2014
Medicals re-done and results provided: Oct start, 2014
CIC requested some updated docs for travel etc: Oct, 2014
CIC requested fresh PCC for all countries: Oct, 2014
Docs & PCC's provided: Dec, 2014
Decision made: Jan mid, 2015
PR visa issued: Jan end 2015 :)


Posting this update hoping it might help anyone in future.
