Canada immigration appeal system called for rejected visitors
Canada, 14th December: The government of Canada is likely to consider introduction of an immigration appeals system following an introduction of a bill in the House of Commons.

The bill has been introduced by MP Olivia Chow, a new Canadian Democrat. It will enable appeals to be made for refused Canada visa applications. Such a system of appeals is already in use for Australia visa and UK visa applications.

As of now, Canada immigration system does not have any such provision for rejected or refused Canada visa applications. So, all applicants whose Canada visa applications have been rejected by the immigration department have no option but to make a fresh visa application.

According to official figures, nearly 20 percent of the total Canada visitor visa applications received every year by Canada immigration department are refused and the main reasons for such refusal are misrepresentation of facts and incidence of fraud.


However, several legitimate applicants wanting to join their relatives for important functions in Canada including marriages, baby showers or others also get rejected by Canada immigration officials and do not have any recourse once their application receives refusal.

And the fact that the total application cost for Canada visitor visa of $75 per applicant is non-refundable adds to the woes of the applicants.


So, the new bill introduced by Olivia Chow will urge the Immigration and Refugee Board of Canada for hearing the appeals.


Every year, Canada immigration department receives around 1 million visitor visa applications.


Pointing to the proposal for an appeal system for rejected Canada visa applicants, Chow said that the aim is to bring increased transparency and fairness in the Canada immigration system.

Australia requires all rejected visitor visa applicants to pay $1,400 for making an appeal and the amount is reimbursed to the applicant in case the decision gets reversed. In the UK, there is no fee for making an appeal for the rejected UK visitor visa applicants.


It is being hoped by the bill will increase the awareness of the public towards the plight of the rejected Canada visitor visa applicants whose family members or relatives live abroad.

Did they send you a letter on PDF format? Did they tell you you're "In process" since Oct 6th? They also gave me a date when they received my package but I doubt it's in process yet.

Bonbon I really don't know if I'm already in process it says they received on Oct 6 and they will mail me more info for the police clearance and it was in pdf format they also say that the average process is 6 months! Is it the same letter that they sent you?

Yes, it is the same letter. Seems like this is the famous "AOR", but I don't know if it means if we're in process already. When was your letter issued? I'll add that date to the table. My eCAS is completely empty, and no updates on my husband's eCAS either (sponsor).

The letter was dated Dec 14 they respond my inquiry 2 work days after so it means they are working! My e cas is not updated yet it works with my uci but the info there is the same from my last application las year so I hope they update the new application soon! What are you going to do respect the police clearance?? I honestly would go to Mexico city to get it just to make the process faster, what do you think? What would be the best?

I can't really go back to Mexico City to get the clearance, but from what I read from PGR's website, my mother could easily get it for me. She called and she can get it on my behalf, the problem is, I don't think the VO will accept a Certificado de Antecedentes Penales from us, they will request the Informe de Datos Registrales, as we're in Canada right now. I hope we will have that option though!

bonbon9, how long did it take you from time of approval in missisauga as a sponsor till your husband heard from Mexico city. I received a letter on Nov19/10 as approved for sponsoring my husband outland but we have not heard anything since. My ecas does not work with my client id number, any thoughts?

My husband never heard from Mexico City. They sent me (applicant) an email with AOR on pdf format. I received sponsorship approval 14/10 and heard from Mexico City VO on 02/12. You might have to wait longer or try sending them an email/case inquiry.

I don't really know where you'd update it if your file hasn't been opened. If it has, they give you a File Number and you need to mention it when updating anything to the VO.

Well after many sleepless nights we finally heard from the Embassy in Santo Domingo. My husbands application is finally in process. The letter said that it went into process on October 7, 2010, although we just received the officially letter today.

Which is funny because I contacted the Embassy in SD and on October 25th the said they hadn't received our application, but we were already in process.

We are just so happy!!!!

Just an up date for police clearnces .

Afetr two days of calling Thai police clearance center , first day they told us thet did not receive application yet . My wife sent this registerd mail november 09 2010 . On second day to talk with them , they suddenly have our application , problem they say sent wrong fingerprints . We or i should say my wife sent what the canadian embassy required according to their letter . Npw she is reapplying to the Thai police .

Should be real mad by now , but just laughing at all of what is happening .

Also , the canadian embassy sent back to my wife all our photos, letters and cards and proof of realtionship . This took from Manila to another part of the Philippines via registerd mail 16 days to reach her ..

Wish every one who is still waiting and for those who are with their loved ones now MERRY CHRISTMAS and a very Happy New Year .
