Can someone help me with this query.

I'm 'landing' in Canada next week but won't be staying this time, it's just a vacation and an opportunity to 'land' before my COPR expires.

I've read the Settlers' Effects Tariff item No 9807.00.00 and one part states that there is a difference between a persons status for customs and immigration.

Does anyone know if I can become a PR for immigration purposes this time but not complete the BSF186 form for customs?

Yes. You absolutely can activate your PR but not submit any customs forms. Also referred to as a 'flagpole' trip. Just tell them that you are activating PR at this time, but are not landing for the purpose of settling on this trip, you will do that on a later trip. You will I am sure have a return flight booked to prove the point.

Awesome, thanks very much. Makes it a much easier trip then as I really don't know what I'll put on the BSF186 form at this point in time.

Yup I have a return flight booked and can easily be proven.

Sorry, just a quick follow up on this. When I check out 'flagpoling' it always makes reference to people already in Canada, going to the US and then returning.

I'll be flying in from HK (British Passport). Is it still the same definition?

Yes, it is the same, it is just that it is almost mandatory to do it as part of an inland application (AIUI only a couple of CIC locations in Canada will allow an inland applicant to 'land' at their offices) so much more common to drive across the border to the US then turn around again and 'land' in Canada.

You can do the same thing from other countries. You will of course need the COPR letters. Also they will not mail the PR card to anything other than a Canadian residential address. So you can either have it mailed to a friends address (timescale not guaranteed) then have them courier it to you, or you get another 'one time only use' form that allows you to land again on your final trip then apply for your PR card then.

I may well be in the same position as you, depends on when London approve the applicant and then what date they give for landing!

Thanks for that, very helpful. I've got the COPR in my hand but we'd booked this holiday ages ago and quite honestly I don't think my PR would be approved so quickly and as my medical expires in March and we're not planning on going back before then I really wanted to 'land' this time.

Flagpoling is when a person is already in Canada and does a Canada-US border run to change their status. What COPRQuestion is planning to do, coming from another country for just a short time to land and then leaving, is called a "soft landing".

Inland applicants cannot flagpole; they must land at a IRCC office. Outland applicants within Canada can flagpole.

Thanks Canuck, so the name aside. I can actually 'land' as a settler for immigration purposes but don;t have to land for customs purposes. I can do that when i eventually move later next year?

The exemption doesn't last forever. I recall a person who did a soft landing and then tried the next year to use their exemption for importing their goods; CBSA told them it had been too long and they would have to pay normal customs and duties. I suggest you contact CBSA directly to ask how long they allow.

Ok thanks, my wife is a Canadian so I understand she has an allowance of CAD 10k per item when she returns anyway, ideally situation is for me to claim goods worth over that as part of my allowance so we aren't taxed on it

There is no limit to the allowance. New or returning residents can bring as much as they want, provided it meets the requirements.

I missed the "per item" in your post. Yes, there are some different rules for items that are valued at more than $10 000 each. May I ask what items you have that are valued at more than $10 000?

Believe me there aren't too many but we do have some items of jewelry and watches that are worth more than that. We've had them for ages and the last thing I want is to be slapped with duty on it, so I can claim it under my goods and thus avoid it
