Hi Sparkle,

I am on a H1B visa too and it expires on Oct 2012. So I guess I will be in status. But did you send all your passport entry/exit stamps (of when you entered/exited the states) with your application?

We sent the photocopy of the passport as required. I guess it should show all the entry exit stamps ?!?!

If you had sent all the pages of the passport, then it should show all the stamps. But if you sent the biographical page and visas as required, it may not have the exit and entry stamps.

I was just asking you because I read somewhere that buffalo would request the entry and exit stamps sometimes.

Yes I read that too in someone's post. But he has his I-797 that we sent (photocopy) and I clearly remember, we took the photocopy of ALL the pages of passport and sent it. I ma just very worried about his H1B expiring on 25th of this month. I hope that won't cause a problem ! He has been here for last 5 years though...just left the country for a month to travel to India for the wedding.

Now, the visa on which your wife is, is it a visitor visa? or like a work visa? Can it be renewed ? There are chances you should be fine until then...but those chances are very slim. My husband's visa expires on March 25, but he is getting it renewed and as soon as we get confirmation for that I will mail it to Buffalo. Because Buffalo definitely wants the applicant to have a proper permit/visa to stay in US while they process your file.

My wife is on a year long work visa. Her contract at her job here in the US runs out at the end of May and her visa runs out in July. She is planning on moving to Canada regardless of whether I can join her to start looking for work. I'll stay and wait and visit when I can. The hardest part is each of us paying rent in different cities while we wait. Do you think there is any problem with our plan? It shouldn't change our status in any way I can see.

Also thank you for everyone who posts and responds here. It feels so much better knowing we are not alone.

finally my wife received her aor in the maile today! dated feb 1, so I dont know if our aor date is feb 1 or jan 24, cuz on ecas it says they received it on jan 24?? oh well im just happy she received it finally! i was getting worried!

Gary

UPDATE: I can finally log into E-CAS and my application says in process.

We started processing your application on March 7, 2011.

I can log into eCAS this morning as well. There's an update on the Sponsor's eCAS, and I can finally log into my own (the applicants). In Process as of March 7, 2011. :)

Hooray! Let's hope we get a letter in the mail soon.

hehe Now I'm all excited/scared! I hope they don't need any more documents... I hope they don't want me for an interview...

Did yours say if they had received your medicals?

What they require is a year long stay in US, has your wife stayed in US for 1 year at least ??
I know what you mean by staying apart and paying rents!! Me and my husband are almost in the same boat....although he is in US and me in Canada, but we are very close to border (~ 1 hour) but can't stay with each other as we both had to maintain the residential address in both countries! So we see each other only on weekends. She can move to Canada on a visitor visa until she gets the PR.....but then I guess if she changes her address to that of Canada, your file may not be considered as outland anymore. I may not be the best to advice you with this, you can probably write a new post on the main forum page, and hopefully someone with more experience can respond.

No, nothing about the medicals. I'm hoping they got them. I'm also stressed out about the possibility of an interview... I am almost sure mine won't be waived since we filed as common-law, and we have only been dating since 2007 (and "living together" since 2009). :(

The interview shouldn't be too bad since I live in Toronto and Buffalo is only a few hours away. What bugs me is that interviews seem to add a few months to the time-line, and I really don't want to wait extra! I want my PPR and I want it now! :D I feel really useless living in Canada and not being able to work. I'm slowly going crazy...

The letter I rec'd said medicals rec'd but ecas has never said anything more than In Process. You should get your letter any day now as I got mine 1 day before ecas was updated.

Gratz Quakingaspen!

Woo hoo! I, too, can log into eCAS as of this morning. Mine does not say In Process yet, just that they received my application as of Jan 19, but progress is progress. Now hubby is impatiently on the lookout for a letter.

@Fleeting I am totally with you on the not being able to work front. It has been nice to get some time off, but I would much rather be working!

Good luck and chins up everyone :)
