We haven't heard anything since Feb when we sent the passport. Just keep saying "Application Received" on ECAS not even "In Process"! Getting tired of waiting for something to happen...

"It is observed that your above-mentioned passport contains Canadian visa issued by the Canadian Consulate located at Buffalo. However, there is no American Visa in the passport. Under the provisions contained in the Govt. of India Passport Act...blah blah blah .. sending of Indian Passports out of a country is violation of the act".

They are referring to my Post Graduation Work Permit and Visa issued at Buffalo, when I had applied for it back in 2006. I had sent my application to CPC Vegreville. Wasn't it normal procedure back then in 2006? I believe it still is.. isn't it? I had sent my passport to Vegreville and not to Buffalo. I have never been to the United States, nor do I have any kind of American Visa.

Is anybody else in this situation? What should I do? I wrote an email and sent a scanned copy of this letter to CGI-Vancouver and also to VFS Vancouver through which I applied to get a new Indian Passport. I guess I should wait for their reply, but getting a bit anxious and see if anybody here has any ideas on what to do.

As per India Passport Act, sending of Indian Passports out of a country is violation of the act. You mentioned that you had never been to the United States, nor do you have any kind of American Visa. But your post graduation work Permit visa was issued at buffalo. So this indicates to them that the passport was sent out of the country.

I do not know much about the post graduation work Permit visa process and hence I would not comment on that. I would advise you to contact an expert immigration attorney to discuss your matter.

Hi,
Who so ever sent you the letter from the consulate is a fool. He doesn't know about the rules and regulations. Because when i was on a work permit even i did the same thing to get my Canadian visa. There is no other way to apply for it. As far as i know the act of sending passport out of country only implies if you are mailing it from India to some other country but in your case you mailed it from Canada to States. So for me you didn't break any law. You should write a letter to them and explain that is the only way to get Canadian visa as you cant apply for a visa within Canada so you had to mail it to States. Indian Consulates are the worst to deal with i hope they will understand

Same here have sent the passport in February and the ECAS status just stays application received . Hopefully you and I will get our passports with VISA back soon .

Any updates on ur end? i guess ur MP wants u to wait till end of this week i guess to hear something from ND?

In general MP would like us to revisit them if nothing comes up in next two months. I have a question, if we took help from MP for the second time does it slow the process? i am guessing file wont be placed at same place once ND update status to MP file might go down again? is it true?

I am thinking to contact MP again after two weeks, its been almost two months i got reply from MP...

dont anxious.everything will be ok.look,u went to canada on work permit before 2006 and that time some class of visas issue from Buffalo.that time was likke this.and after work u got PR.So why they didnt think that time when they gave u PR.I am not much expert but it will not effect ur application.moreover,,my friend sister-in-law has had been to canada on work permit and her visa also issued from baffalo.then when she got pr then she apply for his brother.During application,,there is no any difficulty came on their case.his brother got visa in a processing timeline.No voilation.Also north america is same(Canada & America) so u never been there so there is no record that u enterred into america.I understand ur situation but dont upset.everything will work out.

There is no perfect timeline when ur file reached at CHC ND.I hope it will help to all of those who r waiting for DM

wait one & half month more.If there is no progress in ur case,Contact ur local MP.U will get ur update in few days.

Thanks very much for your response. I am trying to stay calm and wrote a letter a them explaining this. Hopefully, I hear something positive.
