Congrats shijoal and thanks orange_girl for your reply. I guess we are in the same boat, but if shijoal's CC just got charged I think there's still some hope, right?

Hi,

I would suggest you to put the visa office as your country visa office rather than putting buffalo. As per your mail , you are on the J1 visa and J1 visa always have restrictions that you have to leave the country and spent 2 years in your home country , unless you apply for waiver and that's a lengthy Process as well. I would advice you to put your vISA office of your home country. Buffalo is one of the slowest visa office.
Dear mdwantcan,

I totally agree with Sandy. I am one of those who got caught up with buffalo because I did not have enough time to decide between New Delhi and Buffalo. With the rumors of recession hitting back in US and the volatile nature of student and j1 visas, I strongly suggest that you should choose New Delhi as your VO. The only thing you need to think about and answer yourself is whether you will be able to go back to India once you have been asked for your passport for final PR visa stamping. Compare 15 month processing times for NDVO as against 21 months for buffalo VO. Infact, after june 2010, NDVO is faster than 15 months when you look into some of the threads here in this forum. Also, there is no more VO specific checklist and you do not have to submit anymore documents if you choose NDVO unlike a couple of months ago where NDVO required more documents related to spouse employment. I hope this helps but you should consult with other members as well.

All the best!

That's right, I check if my CC got charged several times every day, nothing happened yet. Also we are waiting for reply from CIC, I sent status inquiry last week. Hope we'll get some good news this week.

Thanks Sandy and NKKD,
Does Canada visa office care about my visa type in the US and whether or not I am required to return to my country for 2 years because of a US visa? If so, will J1 status in the US affect the outcome of my application for Canada visa?
From what I understand from my sponsor, I have 3 years after graduating for OPT and the 2 year period is not required to be continuous (it can be accumulated from multiple periods that I stay in my country after finishing the degree).
Another reason that make me afraid is that there is no Canada visa office in my country taking care of the application for permanent resident ( people in my country have to go to another nearby country to do this).
I plan to graduate in 1.5-2 years from now. I am applying for Canada visa because I do not want to go back to my country. If I apply J2 visa for my spouse from now, I hope that my spouse will be able to be in US in 6 months as the latest.
Can someone give me some more advice about should I include my spouse in my application that I will submit this September and request Buffalo visa office for both of us? Or I only submit the application for myself for now and apply for my spouse later after I am granted the PR?
Thank you so much for your help.

Hi mdwantcan,

How can you apply for a j2 for your spouse if you are still studying and you are on F1? Canada visa does not care about what visa you hold as long as you are in legal status during the period of your PR application processing in buffalo. If you choose to apply to buffalo and if you have to go back to your country for some reason ( loss of job or no j1 extension etc.,) you cannot make a personal request to CIC to change your visa office from buffalo to NewDelhi. Such requests are not encouraged and there is a possibility that they might ask you to apply once again and close your application processing at that stage. Since you say that your spouse may or may not stay with you during your period of stay, it is difficult to provide documents that support her presence in USA and it will infact be easier for you to apply to NDVO. Lastly, you should apply for your spouse now itself.

Sent you a personal msg too.

The first thing you need to do is apply J2 visa for ur wife and pray that she gets it as well, once she gets through apply for PR ASAP including her in your application , it would help you fetching some extra points if your wife is graduate. As you are applying under MI3 you can always hope that your process finish before your visa expires in USA.

It doesn't matter if you are J1 or F1 , only the people with B1/B2 cant apply.
