You will have to inform them and send your spouse's documents. Most likely they did not review the info you sent and your application was processed before reviewing the info.

-1- I will inform IRCC again about my marriage, but do I need to send my passport right now? Or just I will keep it with me and wait for new instructions? Cause they told me that I have 30 days to submit it.
-2- My plan is to do the landing and return back shortly to my home country to settle my things. My current situation doesn't allow me to stay in Canada till I receive my PR card. My plan is to do the landing and return back after few days later and I will provide them with the address of my sister who lives in Canada to receive my PR card. Can she mail my PR card to my home country or carry it with her when she come to my home country, then I can use this card PR card when I want to return back to Canada?

1. Just keep it for now and don't send it. Because if you add your spouse, who is not yet added, your current COPR will be cancelled, the application will be reopened and after your spouse's documents are processed, you will be asked to submit the passports for you and your spouse and new COPRs will be issued.

2. YEs. Carrying it in person is better than shipping.

You have to understand what misrepresentation is.

40 (1) A permanent resident or a foreign national is inadmissible for misrepresentation

  • (a) for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;
  • (b) for being or having been sponsored by a person who is determined to be inadmissible for misrepresentation;
  • (c) on a final determination to vacate a decision to allow their claim for refugee protection or application for protection; or


If you do not have the facts, then you are not withholding them. All family member's details are asked as you can later sponsor them and when you do, your application can be looked into to check if you declared all the information.

Given that you do not have information of the person you are referring to, how can you be held liable for misreprsentation?

If you are so concerned, you can include it in the LoE.

@legalfalcon what do You think is happening with the online Outland spousal sponsorship applications from August that have not received AOR yet thank you.
I do not speculate. IF in doubt, call IRCC or check your GCMS notes.

Each application is unique and is processed on its own merits.

If possible could you please help me with these questions:
-1- If IRCC stamped a PR visa on my current passport, then before traveling I renewed my passport, can I use the visa on my old passport for entry? Or I should have a new counterfoil on my new passport?
-2- If I landed in Canada for the first time for about a week and return back to my home country without having the PR card, can I apply for PRTD? Or this PRTD is only available for permanent residents who stayed for a certain period inside Canada?
-3- Do I need to pay the Right for Permanent Residence fee for my non-accompanying wife?

@legalfalcon Hey there! I truly hope that you and yours are doing very well during these crazy times,I'd like to extend that to everyone else in here as well I hope each and everyone of you are well.

I've been doing my best at trying to figure this out on my own but I think I need your help , I've tried contacting IRCC and mp's but they are only able to offer so much assistance and ircc hardly responds ,I was wondering if maybe you could shed some light on my situation

My timeline is as follows

SPOUSAL SPONSORSHIP OUTLAND


- Dec 29th app received
- Feb 11th AOR
- Feb 25th Biometrics instruction letter
- Mar 1st Sponsor Approval
- Mar 1st File transferred to New York Visa Office
- August 28th Medical request
-August 28th Invite to pre-arrival services.
-Medicals Completed October 28th
-Medicals passed November 11th

- Update from IRCC phone agent that our secondary office is Montreal they said once everything is cleared and passed at NYVO this is where we will send all documents. Nov 30th

-Contacted our MP to liaise for us with IRCC and in less than 24hrs had the following response

"Your application was received December 2020.
All of your assessments were passed and a final decision needs to be made on the application.
There are no pending documents on file.
IRCC was unable to give me a timeline as to when the final decision might come."

We've had no communication since December 15th ,and not sure how much longer we should expect to wait, was hoping maybe you could help answer what may be taking so long. I've submitted a request for gcms notes which if this were a perfect world should be in next week.

Timeline -

My( wife) AOR- 30 October 2019 ( my wife primary applicant)
PPR-18 Jan 2020 ( Primary applicant and single)( we did not sent passport for further process and informed ircc about marriage plan)
Marriage- 10th Feb 2020
Spouse added- 15 March 2020
Husband( Myself)- Biometrics added 2nd march 2021 and medical- 14 March 2021
After that yesterday ( 10th Jan 2022)- background status changed to- Not Applicable.

Primary office- New Delhi
Secondary office- CPC- Ottawa

1- Is background status changed to " Not applicable " any major sign of good news for both of us?
2- You don't need a medical.We will send u a message if this changes. ( My wife medical done only once before AOR ( 12 October 2019 only).
3- As per GCMS 9 1 sep 2021- wife ( primary applicant)- medical status- (passed-expired). What does it mean? medical of my wife ( primary applicant will be extended, or remedial will be required?

Kindly guide us- At what stage our application is ? It has been almost 2.5 years and we are still at no men's land.

Hi @legalfalcon, if I were to get an ADR for PoF, will it have to meet the new min requirement (April 2021 increase) or can it just show the min amount of fund required at the time I submitted my application. I'd really appreciate your advice on this.

NO.

You are already a permanent resident. When you enter now, all you need is a PR card and your passport. No PoF required or will be asked. PoF is only asked in some cased when you land for the first time. Once you have a Pr card and have done the formalities of the landing, they can't ask you for the PoF.

If you are flying in, just show your PR card and Passport at the immigration and get your customs done, you are all good.

In express entry, I have claimed 50 points for LMIA approved arranged employment and am waiting for final decision. However now I do not wish to work there.

Is it possible that once I receive PR and land in Canada, I could give resignation on day one itself?

If Yes, then would it land me in any trouble in future?
