Hi All and @legalfalcon,

I have contacted lawyer for my immigration issue mentioned below and they are suggesting me to go for judicial review and mandamus both. Do you think its a right way? What do you suggest.

I need your suggestions, below is the issue I am facing and not sure what step I have to take next. Please help!!

Applied for AIPP PR in June 2020
Received AOR in February 2021
Received ADR (biometrics, employment letter & schedule A) in March 2021 (which will be the last step in approving PR)
Got married in 1st week of April 2021 and informed ircc
Submitted my ADR in 2nd week of April 2021
After 2 days Received a request letter from IRCC Halifax to submit my spouse documents for add-on
In May 2nd week I have submitted my spouse documents including forms, payment, pcc and medical to the same ircc halifax email also got immediate acknowledgement.
After that no response, raised many webforms, calls everytime they mentioned received all my spouse documents will let you know if anything is required.

but all of sudden I have received my eCOPR on 20 August 2021 but my spouse name was never added to my application nor COPR.

In October I have ordered gcms notes and its mentioned "new spouse documents received, recommend pass officer ready " (12 may 2021),status: "open"
Then on may 18 2021 its mentioned " Location: OVS DEP", status: "open"
Then next notes was on August 18 2021 " Location: finalized, status: open
20 August 2021 Location: Registry, status: Retired

Raised multiple webforms, calls and contacted MP but they are not providing proper update. They are asking me to wait till Halifax office responds. Also received a reply last month saying "your file is being looked into by our management team and someone will be in touch with you when it is resolved"

Losing hope day by day not sure when they are going to respond. Can I expect some positive news? I don't understand how can they approve my application as a single even though they received my spouse documents.

If you have a lawyer and they have given you a professional opinion, there is no point soliciting ideas on the forum. Finally, it is your choice.

However, if your AOR is 2021, the mandamus is premature.

Dear @legalfalcon, please help me to understand if it is possible to change spouse from non accompanying to accompanying after a year since received AOR claiming a change in circumstances. Will this trigger recalculation of points?

- Under which circumstances is this possible?

Hi @legalfalcon I have received an ITA to apply as a PNP, but I’m not sure what is the deadline to submit my application. My ITA expires in 2 months but my nomination certificate is only valid until the end of the year and states that I have to apply before the date it expires. Do I have to apply before it expires or do I have the full 60 days from my invitation to apply?

When you submit your application post ITA, your nomination has to be valid as on the date of submission.

If your nomination is expiring, you can ask the nominating Province to renew it and provide you with a renewed nomination.

What is your PR visa expiry date and the COPR expiry date?
I have not received our passports yet. But they had sent an email asking us to confirm if we would be able to travel before the expiry of our medicals. We did our medicals on 4th Feb 2021 and was passed 25th May 2021.

Please advice on my son's situation as well. Thank you.

IRCC takes into consideration all times in UTC. However, the Province of nomination may not. The day and time you apply, your nomination must be valid.

This would mean that you will have to travel and land on or before May 2022.

Hi @legalfalcon. I need your help on clarifying some concern.

I might be sent to US for an international assignment. My medical has already expired on Dec 18. If I'm going to go to US, I believe I have to update my address on a webform and perform re medical exam in US.

Is it possible to go to Canada collect my PR card (assuming I get the PPR) and continue to finish my assignment in US.

Will there be any complications in this?
