Hi @legalfalcon I am asking you this because I am confused after getting two different answers to my question. IRCC asked me to submit an RCMP clearance: criminal record check with fingerprints by June 3rd (30 days) and i went to a 3rd party and submitted my prints on May 4th. It is only today that a call centre agent from CCRTIS called me back telling me it would take 120 days to manually compare my prints to that of the police station I was charged at. But toronto police also told me a criminal record check ONLY shows convictions and I have none as my Charges were dropped theredore it shuld take 1-3 business days to process. All my research online shows a criminal record check level 1 is a report that shows if there's convictions or not and a vulnerable sector check detsils everything from arrest, charges even if withdrawn. It is difficult as everything is done online and somone from CCRTIS says it will take 120 days when it is an rcmp clearance and i have no conviction, just charges that were dropped, which IRCC is aware of as per court documents submitted.
Based on your knowledge does rcmp clearance ONLY convictions or also charges, areests etc. Please advise

I recently graduated and in the process of applying for PGWP. I am an accompanying dependent to my common law partner's PR application (PNP). Our AOR was February 15, 2021. I already applied for her bridging work permit as her open work permit is expiring in August (in line with my student permit). I've decided to take advantage of getting her a bridging work permit based on her PR application instead of applying for spousal open work permit after my PGWP because I don't currently have a full time job. For myself, I've decided PGWP is better as it has 3 years validity and if our PR application takes longer than expected at least I don't have to apply for extension.

Now I am filling in some questions for PGWP - these two questions confuse me:
Have you been told by an Immigration, Refugees and Citizenship Canada office that you are approved in principle for permanent residence in Canada?
Have you submitted a permanent residence application in Canada?


If I answer yes to both questions, it might apply me for bridging instead of PGWP. But if I answered NO on both questions, can I just write an LOE about it. Thank you.

There is no requirement of a no objection. When you file an application, and if you do not what to include your spouse and children, you have to provide their details in the application and submit their documents, however, you can have them as non-accompanying. This way only the person whose application it is will get the PR, but not the non-accompanying dependents.

RCMP does not make a decision on criminal inadmissibility. IRCC does. RCMP will only send the requested information for criminal charges, immigration related offences, any refugee claim etc.

Only the principle applicant is eligible for BOWP, not the CLP or spouse of the principle applicant.

Okay. Do you know if the single point of contact agent at CCRTIS are call center agents or those who actually process fingerprints? Because I only have 2 weeks left and they are very hard to reach. Yesterday someone from CCRTIS contacted me by phone to let me know it would take 120 days to process my fingerprints manually because i already have prints at a police station. But IRCC requested a criminal record check that shows if there's any conviction and i have none as all charges against me were dropped.

Dear @legalfalcon. My AOR is January 2020, FSW outland applicant. My eligibility was passed on 17th August 2020 and after that my file was sent marked for security screening. I recently ordered my second set of CBSA and the details are little confusing.

I am attaching screenshots of the main parts of CBSA which highlight security screening process. My confusion where do i stand in my security screening process. There is a confusion to understand as my activity 1 is redacted, my application 1 shows security screening new value favourable, my note 1 is of Jan 2021 with the comment "CSS submitted".

@legalfalcon, Hello, Could you please help me on this?

I have a review required with "ready to finalize". I read your thread, once you said that Ready to finalize could mean Recommanded passed but needs the officer to review. Somewhere you wrote also that without "ready to finalize" that would be more likely an issue. So is Review required- Ready to finalize not a so bad sign? Thanks.

Understanding “Review Required”

A lot of applicants see “review required” in their GCMS notes for eligibility. There are many theories floating around with regard to what “review required” means and if it is alarming.

Before I venture into explaining the significance, it is important to understand that each application goes through the following stages as per the Immigration and Refugee Protection Act and the regulations (Canadian Immigration Law):

R10 – Completeness Check
Criminality
Medicals
A11.2 – eligibility
Security

Out of the above, the most important stage is eligibility. This is also the most time-consuming stage because your documents have to be verified, evaluated and assessed to ascertain that you meet the eligibility criteria for the program you have applied (FSW / CEC / FTW). To stream line this process and make it easier for an immigration officer (decision making authority), all applications are first evaluated by case analysts or program assistants. They review the documents and summarize it in the GCMS. If they have any concerns with any document or want the immigration officer to carefully look into a specific document, they will flag it as “review required.” It is the content of the note that is important here. If the review required is for a specific document, while the summary of the note says that an applicant has met the eligibility, or “ready to finalize” it simply means that while the applicant has met the eligibility criteria, but the specific document needs a careful examination form the officer before promoting (eligibility pass) by the officer.

However, if there are concerns, there will be a review required for the eligibility, and there will be no text to the effect “ready to finalize” or pass. The note will specifically state job duties do not match, or the employment cannot be verified, or the number of years of work experience claimed cannot be verified. This is where an application can land in muddy waters. But the final decision rests on the immigration officer. He may override the decision of the analyst / assistant or go with the analysis of the analyst / assistant.

Even in cases where the analyst / assistant is of the opinion that the applicant has met the eligibility, and there is no “review required,” the officer can replace it with his own opinion. Though rare, but it does happen. This is why the eligibility is only passed when an officer conclusively marks the eligibility as passed.

Finally, there is “review required” for PoF. This is the most common in many applications. This is because, the financial and banking practices of each country are different. Eg. Fixed deposits are know as Certificate of Deposit (CD) in the US. Similarly, treasury bonds, mutual funds, stocks, and many other investment vehicles are there. If your PoF anything other than a bank deposit, it is more likely that it will be marked as “review required.” Also, IRCC does not go by day to day fluctuations in FOREX. Instead, the Canadian federal government issued a quarterly conversion rate for all FOREX vis-a-via CAD. If your PoF is in a foreign currency, then you may have “review required” for the officer to make a determination.

Just because you have “review required” does not mean that you hit the panic mode. Instead, read the context in which it is there. If there is a concern regarding a document, you can send a replacement document via CSE. The most common reasons for RR are:

1. Work reference letter without job duties
2. Work reference letters missing all the details requested by IRCC
3. If you submitted a letter from a colleague because you were unable to get one from your employer, but did not have a LoE on file, this too will lead to RR.
4. Not sufficient work experience in the primary NOC.
5. Inability to verify your employment as your employer details are missing.

There are just some of the scenarios.

The security screening is not disclosed except the activities that you see in there. Usually you will have 2-5 such activities before the security is passed. Also, each application will go though a different security screening process, based on your individual application. Most inland applicants have record check, whereas outland applicants have a comprehensive security screening.

At an average, as per the security screening manual, it can take 110 days for the security screening to be concluded, and in some days even longer. There is no nothing much that you can do to expedite the process.
