Under the " province " I meant Chinese province, not a Canadian, don't be confused. Yes, they asked for two PCCs from China (from different provinces). It is complex because you should have somebody who will be doing all that stuff as your representative on your behalf.
Right now we are talking about Chinese PCC so definitely I am talking about china province. So find a representative (best is your family members) who will assist you to do this process.
I am sure, letter of explanation won't help to skip PCC. It helps for you to extend timeline. And it helps for the one whose country doesn't issue PCC.

It is not for skipping, it was the best I was able to provide. I can assure you it is not that easy as you think.

The thing is china belongs to majority in the express entry application. So all Chinese should have submitted the required PCCs .
And IRCC knows it . Why don't you in touch with some successful Chinese applicants in this forums?

I agree. It is hard to find a person from this forum who is living in the same city. Maybe it will be easier if its Shanghai or Beijing, but, unfortunately, I lived in a small city, and I cannot ask somebody to go there for the uncertain period of time, right.

I also stopped trying because I found few threads here about Chinese PCC and others, saying that a proof of trying is also acceptable. I attached a communication with Chinese embassy in Canada, in my home country, with my home country embassy in China; the guy from my work place went to the local police where I was registered asked for the help. But the police didnt give even a letter of refusal. So the company wrote their own letter, saying I have to come personally to China etc ..

The biggest concern in that province is that: 1) I am a not a Chinese and 2) I do not have a permanent residency there. That is there argument why I should come to China in person.

I still was able to provide at least a PCC from 1 province. Plus, like I mentioned above, a huge explanation letter.

Hi @legalfalcon

The total job duration is 5.5 years in work experience section, however there is a 7 months unpaid leave in the 4th year. But as the applicant is not claiming any additional CRS points for his work experience after 3 years and also as his MEC points is 71 even after leaving that unpaid period he is thinking about not mentioning it using LOE and also his employer has given him reference letter without mentioning the leave period.

Considering his situation as he is not claiming any points for this experience do you think he should apply without mentioning about this leave? or he should mention and add LOE/ add personal history/ take new reference letter and then apply? he is scared as it is not a big deal doing the later one can complex the situation so he is wanting to avoid it. What is your advice in this?

@legalfalcon a bit complicated case. Will appreciate your time.

I took a notarised gift deed last year from my maternal uncle in July for 9 lakhs. I submitted my application in November. It was refused last week because the officer was not satisfied the funds were free of obligations. He did not ask for any ADR. However, I still have the funds in my account. It's been sitting there for 14 months untouched.

I received my second ITA so I'm planning to send in my new application. I took a new 12 month bank statement that shows 9 lakhs has been maintained for a year. Now my main concern is, can I still need to submit the old gift deed to show the source if the funds or should I get a new gift deed?

Since the funds have been in my account for 12 months, is a gift deed even required now or will it raise red flags again since IRCC already knows I took a gift deed through my previous application.

Thank you

Did your gift deed explicitly state that you have no obligation to repay the amount?

The gift deed was imore like a self declaration in proper format.

Included my uncle's name, his address, the date he transferred the amount to me, his bank and account number and my home address.

It also states, he offered this amount out of his own free will for love and affection. The funds will be utilized in whatever manner I please for my settlement purposes in Canada

The above mentioned assets shall be irrevocable and no other persons shall have any right over the above mentioned assests during my lifetime or thereafter.

He signed it in front of notary. He transferred funds in the morning and the afternoon we got to notarized.

If you are not claiming points for a work experience, you do not have to mention any details about it. Also just sonnet mention it in work history, only keep it in personal history.

If you carry more than 10K cash, you will have to declare it, and show where the money came from. If you can show the bank receipts, or where yo bought the forex, and also where the cash came from buying the forex, you will be allow to take it with you, or else the money will be confiscated and until you provide the train, it will not be released.

If you meet the 6 months average balance requirement, you do not have to provide any gift deed. However, given that you application was rejected due to concerns with the PoF, you may be asked for additional documents.

Dear @legalfalcon ,

Please tell me if I understood it incorrectly. If I am an inland applicant, should I provide a Police Clearance Certificate from Canada as well? Before submitting, I have been living in Canada 1.5 years, but when I answered all the necessary questions to complete my profile, there were requests for my home country and other, where I lived more than 6 months, but there was no request for a Canadian Police Certificate. I am asking you just because my profile is still in process (7 months) and the latest status of my criminality check - in progress.

Thank you

p.s Maybe you can also help me to understand my notes :

Note from CIO Agent : ----- POLICE CERTIFICATE ------ Primary Applicant PA RCMP Screeening NRT 1- China police certificate: Provided-NRT 2-(home country) police certificate: Provided-NRT R10 OK Recommendation: Review Required pending stat question

What does PA RCMP screening NRT 1 mean?
-------------------------------------------------------------------------------------------------------------------------------------------------
Note from CPC Agent: Case Analyst: Recommend Pass Lock-in Date: 2019-03-04 ..... ANALYST RECOMMENDATION: Recommend Pass MI3 SUMMARY NOTES: CLIENT CLAIMED 3 YEARS OF FOREIGN WORK EXPERIENCE, REVISED SCORE TO 1 YEAR AS CLIENT DID NOT REQUIRE 3 YEARS TO MEET MINIMUM CRS SCORE OFFICER PLEASE REVIEW CHINA POLICE CERTIFICATES FOR PA ... CRIMINALITY NOT PASSED. A11.2: Appears Met R87.1: CEC MINIMUM REQUIREMENTS - Appears MET RPRF: Complete

Do you know if criminality not passed just because it requires further investigation ? The thing is I provided police certificate from china but only from 1 province, but i supposed to provide from 2. I was not able to get PCC from 2nd province, because they told to my friend that I should come by myself, what I find completely dumb. I provided an explanation letter instead.
You will be asked for the RCMP PCC. As per the IRCC instructions you do not have to submit the RCMP PCC with your application as it will be asked by IRCC later in the process. However, if you submit it along with your application, you will save some processing time.

Th note you have provided is the R10 note. NRT - No reputable trace, means it is clear.

If you did not provide a RCMP PCC, the criminality will be pending.

Note from CPC, it states that your eligibility is passed.

To read more, you can search one of my posts "understanding review required"

Hi Legal Falcon Sir...... Im in extreme need of your help....... Few days ago i wrote an email to Mr.ERIN and he has replied me through CIC sources are as follows:-

'The application was received at the Centralized Intake office on September , 2018.

The Case Processing Center in Ottawa is currently reviewing the application and documents submitted to determine if the applicant and their family members meet the eligibility requirements under the class for which they have applied.

The eligibility requirements assessment is awaiting an officer review.

The medical examination results have expired for the applicants.

The criminality verifications are currently valid

The security verifications have not been initiated the applicants.

As this file is considered a non-routine one, there is no specific timeframe to finalize it.

Can you please let me understand the whole situation and especially the last one "As this file is considered a non-routine one, there is no specific timeframe to finalize it."

Please help me in this.....Please Please Please
The eligibility takes place in two stages. First an analyst or an assistant will review and make a recommendation. This recommendation is then reviewed by an officer who makes a final determination. Your application is pending an officer review.

The security starts after the eligibility is passed.

You file may have some investigations going on, and that is why it has been classified as "non-routine one." You should consider requesting GCMS notes to see more details.

Hi @legalfalcon

I have 2 queries so your kind reply will help me tremendously.

1.) I am working with a garments manufacturing company.Their company was registered under the address and name of this garments factory( it was their temporary address) (so this address is mentioned in the letterhead of my appointment letter), but we the purchasing specialist used to sit at a different address in the corporate headquarter of the company. Now a year back that factory was relocated at a different location and our company name was registered at the same name but with this new address which is the permanent address of this factory and also I was transferred from the headquarter to this new address which I have in the letterhead pad of my reference letter now. Considering this scenario, do you think I should let the appointment letter and reference letters as it is or I should also add a LOE ? I am scared cause all these address changing case can make the VO confused and make my case complex. @legalfalcon I would really appreciate if you can guide me now about what should I do?

2.) I had a US visa refusal when I was 7 years old, now should I only use LOE to describe the rejection cause and date or I should also fill up the IMM5669E- Section A form also and include it in the LOE section ?

1) IRCC wants you work reference letter on an official letter head which has the contact details of the company and the contact details of the person issuing you the letter. They want these details so that if need be they can contact the employer to verify your employment. It doe snot matter where you work as long as your employer details are current.

2. You will answer yes to the question of prior rejection, and in the space provided provide any details available. No need for any form unless specifically asked.

@legalfalcon

Had a few doubts

1. I am planning to complete my landing procedure at Vancouver as there are no direct flights to Saskatoon and my mother in law is accompanying us on valid visitor visa so will there be any problem for us at immigration. For PR card we are giving Saskatoon address.

2. What documents are required from my mother in law to pass through the immigration.

3. Will there be separate line for visitors and new immigrants.

4. What are the reasons that new immigrants get their entry rejected at Poe.

Thanks in advance.....
1. N problem, you can land anywhere in Canada irrespective of what your city of destination says or your nomination province is. See
https://www.getgcms.com/blog/guide-landing-settling-canada-permanent-resident/

2. Just her visa and reasons to be in Canada. She will be in a different line from you as she is a temp visitor and most likely will be done with immigration before you are.

3. see 2

4. No clear reason to visit, not having enough finances, no get date to return, no address available, etc.
