@legalfalcon I recently received ITA after waiting for a long long time.
I've recently realised that I have a few things on my criminal record that might get in the way of me getting PR though :(

I have 2 offences as a juvenile offender in my home country:
- shoplifting
- possession of marijuana

I also got a DUI in The Netherlands 6 years ago. I blew 0.04, which means I was under the limit of 0.05, but it turned out that they have a different limit for people who are within the first 5 years of owning their driver license. I got a ticket in the mail, which I paid for back then.

Because I thought this was just a traffic ticket and because the other 2 offences were before I turned 18, I never mentioned this when entering Canada many times in the past and when successfully applying for a working holiday visa. I applied for my certificates of good conduct in both countries and both came back clean, which I thought confirmed this.

Am I meant to apply for criminal rehabilitation now? I'm concerned that if I apply now, I might get a ban for apparently lying/misrepresenting in the past.
Can I just explain this on my PR application instead and avoid the really long waiting time for rehabilitation, since juvenile offences don't make you inadmissible and there is no similar crime in Canada for being in the first 5 years of your license plus I was under the 0.08 Canadian limit?

If I do apply for rehabilitation, can I apply for TRP and visit Canada in that time? How long does it take to get TRP?

You are only inadmissible for serious criminality if you fall under one of the following:

  • 36 (1) A permanent resident or a foreign national is inadmissible on grounds of serious criminality for
    • (a) having been convicted in Canada of an offence under an Act of Parliament punishable by a maximum term of imprisonment of at least 10 years, or of an offence under an Act of Parliament for which a term of imprisonment of more than six months has been imposed;

    • (b) having been convicted of an offence outside Canada that, if committed in Canada, would constitute an offence under an Act of Parliament punishable by a maximum term of imprisonment of at least 10 years; or

    • (c) committing an act outside Canada that is an offence in the place where it was committed and that, if committed in Canada, would constitute an offence under an Act of Parliament punishable by a maximum term of imprisonment of at least 10 years.
  • Marginal note:Criminality

    (2) A foreign national is inadmissible on grounds of criminality for
    • (a) having been convicted in Canada of an offence under an Act of Parliament punishable by way of indictment, or of two offences under any Act of Parliament not arising out of a single occurrence;

    • (b) having been convicted outside Canada of an offence that, if committed in Canada, would constitute an indictable offence under an Act of Parliament, or of two offences not arising out of a single occurrence that, if committed in Canada, would constitute offences under an Act of Parliament;

    • (c) committing an act outside Canada that is an offence in the place where it was committed and that, if committed in Canada, would constitute an indictable offence under an Act of Parliament; or

    • (d) committing, on entering Canada, an offence under an Act of Parliament prescribed by regulations.

Hello @legalfalcon. My AOR is April 11, 2018 and I've been in eligibility review since April 19th. I have since provided them with additional documents regarding work experience (reason for review) in October, but no progress has been done in the file since June, 2018 (As shown by GCMS notes). I'm currently in Canada with a student visa. I'll be graduating this April. Is it possible that my student status is one of the reasons for the delay? Could they be waiting for me to finish college to finally move on with the process??
No, your eligibility has nothing to do with your student status. If you are legally in Canada, that should not be a concern.

All my education documents are issued in a short form which is P S Bharadwaj Mantha and my passport is issued with my full name Mantha Priyank Shyam Bharadwaj (as mentioned above). I have two questions??

1. Do I need to create a WES profile as per the name mentioned in Passport?? or the education documents
2. Will it be problem in my case which is a short form (as mentioned above) if yes, what all the supporting documents do I need to submit to overcome?
3. Do I need to mention in a section where do you call by other names as YES even though it is short form of the name.

1. No matter what name you write in your WES profile, your ECA will have the name as it appears in your degree.
2. You can include a same name affidavit.
3. No, that is only for name change.

No need to worry. This is a common request. They want to see whether you have a plan or not. That is it.

Due to currency fluctuations, my funds have fallen short of 200 CAD.
I have submitted the updated POF adding more money and keeping some cushioning amount,
My question to you is that what does the underlined statement mean "SETTLEMENT FUNDS DID NOT MET THE MINIMUM REQUIRED FOR THIS ROUND"
This sounds negative and not positive at all. Will they accept my updated POF? My file is untouched since October 2018. Kindly help.

I have applied for PR through FSW-O
Country of Citizenship: Pakistan
Residence: Dubai, UAE [for last 8 years]
My wife is a British citizen of Indian Origin [born and raised in the UK] and is living in Dubai for last 7.5 years

My AOR is 28th Aug'18 [1 week away from completing 6 months]
As per my GCMS notes and as per my conversation with CIC call center agents, eligibility and criminality was passed on 6th Nov'18 and security started just after that

So basically my security is going on for last 90+ days

I have just ordered GCMS and CBSA notes last week

My previous GCMS was ordered on 23rd Dec and received on 23rd Jan. I could see S15(1) under security with a blank page. Couldn't find the word 'security screening' anywhere though. As per getgcms.com, I don't have to worry about S15 as it means security is ongoing and a response is awaited from organizations in other countries

Also, I have been to 9 countries till now

Any idea on why my security is taking this long?

Do u think I could be under security screening? Dubai is one of the safest places in the world and I haven't travelled to any places of political unrest

Hi sir. i am an applicant for PR since june 2017. just recently reciever PPR. i want to know that do i also have to do biometrics, though it is not mentioned on request letter.?secondly i paid RPRF fee upfront.do i have to pay any Govt of canada fee at VFS?
If you filed your application after December 2018, you will need to provide biometrics.

If you have paid RPRF this is no other fee. However, VFS will charge a processing fee which you have to pay.

We would appreciate any and all advice regarding our current PR status. We applied to the PR through provincial nomination a year and a half ago. We have submitted all the additional documents in a timely manner. The IRCC deadline was February 12, 2018. It's been a year, and the application is still in process. We have requested the GCMS, CBSA, and CSIS notes (which did not provide any additional insight because most of the things were redacted) and sent multiple emails to the IRCC via the web form (which are always answered with the same copy-pasted message of "We are working on it."). We are currently in a hellish limbo, as we live in another country on a work visa. In your opinion, at which point can we turn to the court and lawyers regarding the exceeded processing time and complete lack of communication?
When you say it is retracted, there mush be some info in your GCMS notes. What does the status on page 2 of the GCMS notes say?

I lived in Australia for last ten years ,just came back to india because my visa is expired. Now I am waiting answer from canada immi .I didn't update my address yet .
my question if I update my address Australia to india it will effect my application or application processing times .
Canada immigration is too slow, really frustrating.they keep increasing processing times .dont know, what to do??
Changing your address will not delay the process, rather it will streamline it, when you get your PPR, it will be from the country your address is in. If you are in a different country, you will then have to get the address and visa office changed, which may take time.
