Hi legalfalcon,

My wife changed her mind about moving to Canada half way through the PR application process. She also did not want me to move there and did not submit her passport for the CoPR (I'm the primary applicant).

She also filed a one sided divorce petition on the 10th of Jan. I travelled to Canada for my PR landing on the 12th of Jan and only found out about the divorce petition on the 15th of Jan when I got a summons (in India) from the relevant court.

Could this affect my PR status ? I'm looking at an ugly divorce and don't want to lose this as well.

Any insights would be appreciated.

  • Is it mandatory to have 3 years MNI to sponsor my parents?

1. You can show your passport with your parent's name. That will work too. Usually birth certificates do have name. If your BC does not have your name, explain it in LoE.

2. When your mother changed her name, was there a gazette notification? If you have one, you can include that. Alternatively, you can get an affidavit from your mother, entering all these details, and get it notarized.

To sponsor your parent or grand parents for a PR, you also have to provide proof that you meet the income requirements for each of the 3 taxation years right before the date of your application. So you are not eligible as of now. After you meet the 3 year taxation requirement, you may be.

If you have already landed, you need not worry about your PR status. Simply inform IRCC of the divorce and provide them with the proof of the divorce petition. They will remove your spouse from your application.

I submitted the case inquiry from GETGCMS website about notes not received.
I received reply from the website support people that they will submit the case inquiry to IRCC.
How long after the inquiry submitted to IRCC, I can expect the notes
The GCMS notes are released under the Access to Information Act. As per section 7, the agency ha to release the GCMS notes within 30 days of receiving the request. In some cases the notes are delayed. This delay is due to an administrative issue or your application being at the final stages of processing.

GET GCMS will keep you appraised of any communication they receive from IRCC.

I've not gotten any ghost updates or ADR till dates. I've even been looking forward to rejection since last year but no movement at all on my file. My first note was requested in October and my second in December, its all the same expect to show they received the additional documents I sent.

ready to finalize means that your eligibility is met subject to any review required, and is ready for PPR after security.

Hi there. I received NOI from OINP yesterday but it doesn't specify which substream. However, all of the people who I've run into in this forum with NOIs issued yesterday have NOCs starting with 72,73,82. Even my friend and I have NOC 8232. If I go over the OINP skilled trade stream, it clearly mentions that these NOCs are skilled trade ones which require applicant to have one year Ontario work experience, legal status in Canada and license to practice from Canada. I have none of these things and the crazy part is I never chose any options in my EE profile to make OINP or CIC think that I do (Even my friend didn't). I don't know if I should go ahead and apply for OINP in the stipulated 45 days and even if I go ahead, should I apply under HCP or ST streams. Furthermore, I'll have to analyze your answer but whatever you advice, I still have to verify from you if applicants can choose NOCs starting with 72,73,82 if they've never worked in Canada, for even standard federal EE application? I had to pick 8232 because that was the one that most resembled my actual job duties and none other did. I even remember that at the stage where they ask for picking NOC while filling out the EE application, they clearly stated that "Date you first qualified in a certain NOC is the date when you got license to practice it in Canada if the NOCs are 72,73,82 and for all other NOCs it is the date your graduated". However, even though I picked 8232, I still went ahead and put the qualification date as my graduation date. Should I refuse to submit application for this NOI and rather change my NOC from skilled trade ones? Sorry for the long question, hope you can advice.
If you received NOI from Ontario then it is under the Human Capital Stream, which is not driven by NOC.

A ghost update is a movement in your application, which can be a file moving from CIO to CPC, or a progress on your file like the R10 met. Nothing to be concerned about it.

To know the exact stage where your application is at you need GCMS notes.

@lega falcon, i am ontario nominated applicant, already 6 month pass aor, aor dated 28th july2018, i ordered gcms on 6th january so waiting, profile showing only medical clear, we r reviewing eligibility,nothing else started, so what u think about my case
The 6 months processing time starts from the date when the R10 is passed, and not AoR. Wait for your GCMS notes, and the situation will be clear.

If you received NOI from Ontario then it is under the Human Capital Stream, which is not driven by NOC.
Actually, Human capital stream has three substreams. One of them is driven by NOC as they only invite certain skilled NOCs. If it was not driven by NOC, then it's strange that they invited some people with sub-400 CRS score and left out some people with scores more than 438

No, it is just review required. Which is a way of flagging an issue for the officer to look into it more closely. Since I am not privy to your documents, I can't say much.
