It will depend whether you worked for a law firm, were a sole practitioner, or an employee of a company.

Dear @legalfalcon,

Thank you so much for your response. After doing more research, I have realized that I made a mistake selecting the NOC code in my PR application. I know that it looks so silly mistake for a such big thing. I would like to rectify this ASAP. Can you please give me input for this issue? I guess that I need to raise a CSE and provide LOE but anything else I can do so that this doesn't affect me in negative way.

Please advise. I would greatly appreciate it.

Dear@ legalfalcon,need some suggestions...I ordered my gcms note month back nd we found out that agent put our file on eligibility not met- for refusal, reason was job duties and salary slips were not provided in my current and previous job as well...I understood that made a big mistake I raised CSE nd provided new Reference letter from my current job mentioned all needed datails.but couldn't provide references letter from my previous job bcz previous company got shut 5 years back ...I could only write on letter of explanation those duties nd wrote that it dsnt existing anymore,though I don't claim any points for the not existing one ..I have 6 years of experience from my current job..I'm ip1 Aor may9..what are my chances to get PPR...or what else can be done how else can I help it?I don't want get refusal my points will got down due to birthday nd I will not be able to get ITA again..please suggest...

IRCC states:

Minimum work experience requirement
The applicant must have accumulated at least one year of continuous full-time (or the equivalent in part-time) paid work experience in the occupation identified in their application for permanent residence as their primary occupation. In calculating this period of work experience, the occupation must be listed in skill type 0 (Managerial occupations), skill level A (Professional occupations) or skill level B (Technical occupations and skilled trades) of the National Occupational Classification (NOC) 2016 [R75(2)(a)].

The applicant’s skilled work experience must also

  • have occurred within the ten years preceding the date of their application for permanent residence; and
  • not be in an occupation that has been designated as a restricted occupation.
Note: At the time of publication, no occupations were designated as restricted.

In addition, during that period of employment, the applicant must have

  • performed the actions described in the lead statement for the occupation as set out in the occupational description of the NOC [R75(2)(b)]; and
  • performed a substantial number of the main duties, including all of the essential duties, of the occupation as set out in the occupational description of the NOC [R75(2)(c)].
Note: The applicant does not need to demonstrate that they meet the “employment requirements” listed in the NOC occupational description.

You do not have to meet the educational requirements. What is important is that your job duties should substantially match those of the NOC selected.

Finally, I’ve obtained a job reference letter from my supervisor. I will be extremely grateful if you can review and suggest which NOC is most suitable to me 0122 or 6235. Or even 1114 if that’s an option. Thanks again!

I am submitting my application in few days. I have some doubts regarding history section. Please advise.

For travel history, how we should make entries? Is it departing from india and arriving in usa or departing from india and departing from usa?
I have left US on Jan 2017 and staying and working in India since then. So should i select this trip as ongoing?

Also the entries from and to is leaving india to us and coming back to india (stamps) or leaving india and landing in USA?

For example, I left Apr 15 2016 from US and reached india on Apr 17 2016. I stayed for couple of months and returned back to US on July 7th 2016 (Indian stamp of departure was July 6th 2016)

So will the travel history entry be from Apr 15 2016 to Apr 17 2016 or Apr 15 2016 to July 7 2016?
  1. Personal history does not have days, just months and years. So how can we be accurate and not miss a day? Since i am answering yes to Statutory questions, i am filling schedule A form as well. So can i add days to personal history section on a separate sheet of paper or should i go ahead with only months and years as required?

  2. My indian address is not fitting in EE address history. Is it okay if the address is incomplete in EE ITA section?

  3. I am unable to download schedule A form, i am getting a pdf message. Any place where i can download?

Good day,

My crs score increased from 425 to 450, this is due to my three years of work experience. Technically my work experience will be 3 years on Dec 6, 2018 because I started on Dec 5, 2018. So I inputed Nov 2015 - Oct 2016; Dec 2016 - Present. I believe my score will qualify for the next draw, should I accept the ITA if ever I will be invited this month?? Or there will be problems involved??

7 months ago my file was transferred to Vancouver office and then I got an additional documents request (Updated Job Letter). And yesterday I got this mail. I am totally confused about what stage I am at and how long to wait

In the documents for the name change, simply submit the marriage certificate. You do not need any other document.
Thanks. On marriage certificate only her new name is mentioned (that is new surname as mine). So will that work? How do they deduce that what was the older name?

@legalfalcon One more query on PoF

I received ITA in oct oct first week. Balance in my account was 1 lac on that day. My oct monthly salary was higher at approx 4.5 lacs and my nov salary wud wud be higher at approx 3 lacs. my regular salary is 1 lac.This higher salary is driven by RSU vesting in these months ( part of employment). my bank account shows high entries as follows -

Oct 20 - 3.5 lacs
Oct 31 - 1 lac
Nov 20 - 2 lacs
Nov 30 - 1 lac

i have a document from morgan stanley (US Broker) stating USD value of RSUs sold. Bank statement has just an entry in INR. what all prrofs shall i show to confirn this is my money?

Also, i wont hv good enough average balance - would that be an issue?

I received my gcms note today. the notes shows review required: A11.2 appears met, r87.1 review required. Why it shows that? Is it because my quebec residency? But in the gcms note I didn't see any concern about quebec residency.

I am under immense pressure currently and getting nervous regarding my PR application. Let me explain you my case in detail:

Applied with Spouse and I am the primary applicant.
My ECA Summary says - 2 Bachelors Degree each of 4 years
My IELTS score is - L/R/S/W : 8.5/9/7.5/7
NOC Code - 0601 (Sales Manager)
Experience claimed for - 3 years and 4 months
Age - 31 when applied
Wife's ECA Summary says - 2 Bachelors Degree each of 4 years
Wife's IELTS score is - L/R/S/W : 7.5/7.5/7/6
POF Shown - CAD 19000; (Required is CAD 15331 for 2 applicants)
TOTAL CRS is - 461; got invited on June 25th when the cut off was 445

My AOR is 14th August 2018,
When I emailed Ralph Goodale on 29th October to know my status update, he mentioned -

"your file is at "Sydney Nova Scotia and your Eligibility was not met and Background Check and Criminaltiy check have not been initiated"

Then I called up CIC customer care and the lady said the exact thing and told that my eligibility was not met and is under review.

I am worried as to why I was not able to meet the eligibility in spite of providing all the right documents and claiming right points? What do you think could be the primary reason. I also showed my work experience of two companies as 'Sales Manager AND Manager - Business Development' respectively and made sure that my duties and responsibilities matches the NOC.

Quite concerned right now. I ordered GCMS notes last week and awaiting a detailed report as to what happend. However do you think a case analyst sometimes can make mistakes or don't get into detailing of NOC and its the VISA officer who would have the last say? Do I have any chance?

Please help.
