Yes, you and your spouse can both apply, however before you apply your EE PR application should have been filed and R10 should be complete.
Great thanks!
Unfortunately it's too late to order notes but I submitted my application July 14 so approaching 5 months I'm guessing the R10 should be complete by now

Dear LegalFalcon,

My wife is a medical doctor and we have done her ECA through WES, it says it is equivalent to Doctor of Medicine. Now I know that for primary applicants applying as Physicians, ECA has to be done through Medical Council of Canada. But could not find any reference for spouse. Should I select Bachelor or Professional degree for spouse in my Express Entry profile, please suggest. I was expecting initially that WES will classify her degree as Bachelor. I also dont understand that if CIC does not accept WES when WES classifies as professional degree, the why not WES simply classify it as Bachelor degree. CIC has given licensed to WES, they should have some common understanding, its really confusing. Thanks in advance.
If I get your questions right, you are the primary applicant and your spouse, who holds a medical degree, is the secondary applicant.

If this is the scenario, then you can go ahead and chose your wife's qualification as "PROFESSIONAL DEGREE" as stated by WES since she is not the primary applicant not claiming points for specialist physician (NOC 3111) or general practitioner/family physician (NOC 3112). All CIC states is that since medical degree is a specialized one, not all agencies are competent to provide equivalence for it, and that is why they ask that medical education be accessed by Medical Council of Canada. On the other hand WES does provide a basic credential assessment, except for physicians and pharmacists. But since WES has accessed her degree as professional because she holds a degree in which you need a license to practice, similar to lawyers. That does not mean that her education is equivalent to or Canadian medical education, but only that it is a professional degree.

It may sound confusing, but is actually very straight forward. However, your wife will have to get her education evaluated from Medical Council of Canada if she intends to get re-certified in Canada. For then purpose of your EE application where your wife is the secondary applicant, the WES would do just fine.

Hope this helps!

If your application if 5 months old, definitely the R10 should be complete. I wrote this note for the BOWP and sharing it with you in case if it is of any help:

Bridging Open Work Permit – Procedure, filling the application form and other aspects

This is a short guide for applicants applying for a BOWP. The manual to help fill the application and the criteria therein is set forth in the manual available at http://www.cic.gc.ca/english/resources/manuals/bulletins/2012/ob485.asp.

The first place to start is by verifying if you are eligible for applying for a BOWP. The eligibility criteria is as follows:

a) be currently in Canada;
b) have valid status on a work permit that is due to expire within the next four months;
c) be the principal applicant on an APR under the FSWC, the CEC, the FSTC, the PNC, or one of the two caregiver classes;
d) have completed one of the following APR stages:
I. their electronic application for permanent residence (e‑APR) submitted under Express Entry has passed the R10 completeness check; or
II. they have received a positive eligibility assessment on their paper APR submitted by mail under one of the economic classes above;
e) have applied for an open work permit;
f) have paid the work permit processing fee and the open work permit holder fee; and
g) have provided, as applicable, evidence (e.g., nomination certificate) that their provincial nomination is unrestricted.

Once an applicant is eligible to apply, he should then gather the necessary documents that have to be enclosed along with the BOWP application form.

1. Application from IMM 5710. (If using an authorized representative you will also need IMM 5476 & IMM 5475)
2. Proof of Payment
3. Photocopies of passport biographical page.
4. Photocopy of your current immigration document.
5. Photocopy of your marriage certificate if applicable.
6. A copy of your AOR for the EE E-APR

If you are a PNC applicant you will also need the following in addition to the above:

1. Letter from the provincial government that confirms the province has nominated you.

How to fill the form:

• Choose either “A work permit with same employer” and/or “A work permit with new employer”
• There is no need to indicate a specific employer since its an open work permit
• If you are a PNP applicant you will have to write your location as the same province that has nominated you as it will be one of your work permit conditions.
• Your occupation should closely relate to the NOC that you have mentioned in your EE profile.
• There is no need to give a LIMA number. Leave it Blank.
• Fill in the other details and make sure that your eligibility in the EE application has been met.

For an in-depth detail of the procedure read the Operation Bulletin 485 available at:
http://www.cic.gc.ca/english/resources/manuals/bulletins/2012/ob485.asp

Thank you very much for your reply :) :) :) Yes I am the primary applicant. I am expecting ITA soon with 482 points. It will be frustrating it I get ITA and it gets rejected due to this. My wife also does not plan to practice medicine here. I have another question if you dont mind. Can I select her ECA as bachelor even though WES made it professional, I mean is it technically wrong? I know claiming more point is wrong, dont know how the opposite works :D Thanks again, you are so helpful :)

If you are really concerned about it I would suggest that you get her education accessed by the Medical Council of Canada. You will have to wait a little. However, you can chose "Professional" as per the WES ECA, but if you want to select Bachelors, that would going against what your report says, not that you cannot do it.

Another way around is that you chose "Professional" for your spouse and when you file your application include a letter of explanation and state that since your wife does not plan on practicing in Canada as a physician you do not want to get an evaluation from MCC.

Hope this helps!

Hello, thanks again, I will definitely go for an explanation letter. Went for WES as it is cheaper and faster, and was expecting that they would classify the degree as bachelor. I wont mind 2 points, but they end up defining it professional degree :-| Thanks again for your time :)

Hi Legalfalcon
I have question for the financial documents. I have my salary account in one bank, and a credit card in another bank and a fixed deposit in a third bank. While I can get statements from all, do I need upload all the documents from all three banks or just my salary account? I am particularly concerned about the credit card as a declaration of liabilities? thanks

Hi Seniors,

Can anybody clarify, if I need to put my biological father's name in family info. It has been 3 decades since my mom's separation and we haven't kept any contact with him since then. Plus I have absolutely no idea about his DOB / DOD.

But I have filled in my step-dad's details.

Thanks

As per the CIC requirements you have to provide a proof of funds. If your salary account meets that you are fine. If not, then you can add additional bank accounts to show that you have the required proof of funds. As regards liabilities, if you have a credit card for which you pay the balance every month, you need not worry. However, if you have a pending balance, only then should you include that statement.

Yes, it is biological father's name. However, if you were legally adopted by your step father, then you can go ahead and put his name as his name should be reflected in your official documents.

Hello I just submitted my application and received AOR. However, I noticed something:
when we are asked to upload documents, the file name is Employment Record 1, Employment Record 2 etc... After the application is submitted, the actual job title appears instead of the number, so the file name is Employment Record "Job title"

SO, I just noticed that the reference letter for the first employer was uploaded against the second position, and visa versa. Is this something that I should worry about? Please note this is for my spouse in which no points were claimed for her experience, but I was still required to provide.

Regards,

Nothing to worry about as long as you have all the document in. If you want you can send a Case Specific Inquire informing them of the inadvertent error, although it is not required.

Hi,

1. Do you know when I will receive my PR card after landed in Canada?
Di you give your address in Canada when you did your landing? If you did not give your address to the officer at the port where you landed then you need to update it by sending a CSE. There is no fixed time when you will get your PR. It takes a few weeks to a few months to get it. Check the latest processing times <http://www.cic.gc.ca/english/information/times/> As of today it is 41 days.

2. I need my PR card very urgent as I need to back to my home country and return to Canada shortly after, do you have any advice?
There is no way to get your PR card urgently. If you need to travel to your home country you can do it and ask someone in Canada to ship your PR card to you when it arrives or apply for a Travel Document from the Canadian Embassy when you are in your home country.

Thanks so much
