Hello Legal Falcon, thanks for your reply on my last post. though I have another query here,

I am inland OINP received my nomination on 15th APR, my eAPR AOR is 26th May and my PR application is still in progress though my OINP nomination is just expiring today. Do I need to ask OINP to Extend my Nomination? or it is all fine as I have already got the ITA after getting nominated?

Your ONIP nomination has to be valid on the day you file your application, even if it expires after that, there is no problem. Since you have filed your application you are all good need not do anything. It is not the ITA, but the e-APR post ITA which is important.

It will depend on a lot of factors which include, where all have you lived, your travel history and other personal details like marriage, country of origin etc. Usually the BGC takes 3-4 weeks, but it can be longer for some applicants. Since CIC does not conduct the BGC, there is no time frame or a definite date that can be given.

I am in pursuance to ECA from WES and after that will create profile in EE. I had completed my Secondary onward Masters from Pakistan and PhD from Italy.

Strange issue, I just noticed, a conflict in the last name of my deceased father:

• Educational diplomas and transcripts (from Secondary onward Master's diploma), Father's Name: IKRAM HUSSAIN
• My legal docs (CNIC, NICOP, Passport), Father's Name: MUHAMMAD IKRAM
• My Father's CNIC and Death Certificate, same adheres: i.e. MUHAMMAD IKRAM
• On My PhD diploma, Italian documents and residence permit: NO Father Name is mentioned

I have applied for WES ECA from Secondary onward PhD, currently under process.

As I am in Italy now, I have to go to Pakistan for following two plausible solutions to resolve this Name conflict:

• I should get modified my all educational documents from Secondary onward Masters from Pakistan first, which is quite a hectic and will take 6-8 months at-least. Even though, If I get it done from Pakistan, from Italy I need to update my uni records, or to inform legal authorities for updating records in my residence permit database, though on italian residence permit, no father name is mentioned
• As father is deceased, so I have to obtain a COURT ORDER to modify deceased father's name, and then apply for my modified CNIC, NICOP and Passport, which is also a big challenge considering long duration, hectic process, court and lawyer and I am here in Italy, etc.

My Questions are:

• Is there a solution, by which I don't need to go through above plausible solutions?
• Would WES raise an error against that conflict or it won't effect my ECA Report (as ultimately, I will get PhD equivalent, and on PhD diploma no Father's name is written, Moreover on ECA Report Father's Name is not mentioned (I checked sample reports from slideshare.?
• If NO issue in WES ECA and I get ECA results, would it be a problem of 'father's LastName conflict' after ITA (during Post-ITA or in any further stage during whole immigration problem)? I mean if there's a way to bypass this now and later I provide a kind of self-certification? I don't know...
  

As my father's name matches with my legal documents, his CNIC and also his death certificate, but issue is on educational documents (from Matric to Masters Degree), considering PhD diploma don't contain father name as well.

The WES report does not mention father's name. So I would suggest that you send your educational diplomas to WES for evaluation and get the results. You will not be asked to upload the education documents, only the WES report number. Since your passport has your father's name as you want it, make sure you keep it consistent in your application as how it appears in your passport.

If at the filing stage, post ITA, you have any documents that have a different name for your father, just make an affidavit to the effect that this is your document and you fathers name has been entered differently.

Not a big issue. I have seen other applicants who have issues with their own name spelled differently, that is what creates an issue.

Yes, you get extra points for the nomination and are almost certain to get the ITA. Usually the PNP applications are processed faster, but it depends from application to application, no one can say with certainty what is the timeline.

The CIC evaluates your profile that you create against the documents you submit post ITA. Other profiles that you created which were rejected or which were withdrawn by you do not matter. Just make sure that you latest profile and the one your submit after the ITA match.

Thanks @Legalfalcon for providing me concise and logical solution, in this way I can bypass said two plausible solutions.

Now the real challenge is to get attested photocopies of diplomas and transcript from Higher Education Commission (HEC) in Pakistan, as WES requires sealed envelopes of my Bachelors and Masters Degrees from HEC, though PhD attested copy I will get through my university in Italy (No issue at all).

In fact, while being in Italy, I tried to get HEC attestation through courier service, later courier service returned me back the documents by stating an objection: "they will not forward my documents to HEC for attestation due to this naming conflict". The only way is, I visit personally HEC office in Pakistan, as my original degrees have been already attested from HEC before I came to Italy, now I need only photocopies attested. I hope they will not create an issue this time for attesting photocopies, considering originals are attested before and my physical appearance will prove authenticity.

So summarizing, I don't need to either apply for modification on legal ID documents (CNIC, Passport, etc.) as father's LastName matches with his CNIC and death certificate as well, nor I need to apply for modification on all education diplomas..right? as WES report doesn't contain father's name and no where I need to upload these diplomas as you mentioned. I will be consistent throughout my application, if needed later, I will provide self-certification or affidavit, as you advised.

Thanks again for your valuable support, feeling quite relax now, just had to visit Pakistan to HEC, even then there would be any issue, I can get ECA from IQAS (as they don't demand HEC attested copies, rather from universities, which I can get through paying visit to my previous universities in Pakistan.

1. PCC if I get it done today and the same us valid till the time I submit my application and it expires till the time if or. Do I need to get it again.

2. Medical is valid for how many months.

3. My 4 years daughter was diagnosed with typhoid. She is been cured and injected but if it still comes in lab test. Is it a cause of concern for my application n medical exam.

4. I have a spine and cholesterol problem. Are these major for medical exam.
Please help me.

Yes, you are right. I am not sure why you are sending high school certificates. You only need to send in your undergraduate, graduate and post graduate work and not high school. But if the rules have changed, do check.

If its the PCC of your country of residence (where you live now) then the police certificate must have been issued no more than six months before the submission of the e-APR.

For countries in which the applicant no longer resides, but were residing earlier, the police certificate must have been issued after the departure date of the last time the applicant resided in that country for more than six months.


2. Medical is valid for how many months.
Medicals are valid for a year. Once you file an application and get the PPR you have to enter Canada before your medicals expire.


3. My 4 years daughter was diagnosed with typhoid. She is been cured and injected but if it still comes in lab test. Is it a cause of concern for my application n medical exam.
No, as long as its been cured, there is no issue and in the medical they don't even screen for Typhoid. Before you go for your medical, consult your personal doctor and make sure that it has been completely cured and cannot be traced. This way you won't have to disclose it before the medical.

4. I have a spine and cholesterol problem. Are these major for medical exam.
Cholesterol is not an issue as its not an ailment and many people have it. As regards spine, it will depend on what condition you have. It its a minor pain, there is nothing to worry. If its something major, then yes you will have to disclose it. Just remember that CIC is concerned that you as a new immigrant don't come to Canada and become a liability on the medical system. Minor conditions such as high BP, diabetes, past surgeries do not effect your medical assessment.

CIC is interested in verifying the following two issues:
1. whether you have a condition which poses a danger to Public Health and Public Safety
2. If your condition puts excessive demand on health and social services

thanks a lot
