Dear Legalfalcon,

I hope you can answer me

I had called CIC couple of days back to know my status and the nice agent told me that my file is in Ottawa and also my eligibility is passed and recommendation is made by the analyst. He also said that my security has not started yet but rest everything is complete.

I called them again today because of my anxiety and the lady who spoke with me told that both eligibility and security is not complete. So I questioned her regarding the former response from the previous agent. Then she told me that only 98% of the eligibility is complete . What does she mean by that? does this happen that the agents say different things? I am just confused and lost right now.

please do reply. Thanks

The eligibility is a 2 step process. In the first step a case analyst, or a program analyst reviews an applicants eligibility and makes a recommendation. This recommendation is not final. The recommendation is then reviewed by an agent, who in most cases agrees with the case analyst or programme analyst, and only after this, the eligibility is passed.

After the eligibility is cleared, the security starts.

If you want an in-depth progress of your application, you should order GCMS.

You should go with plan 1. But there is no linking of application. You will have to file in and file [IMM 5406 (PDF, 570.00 KB)], pay the fee and make sure that your PoF now takes into account 2 people.

http://www.cic.gc.ca/english/resources/tools/perm/express/refuse.asp :

Section A11.2 does not apply when an applicant adds a family member to their application after the e-APR; however, the family member will have to be assessed, and the principal applicant must provide IRCC with the Additional Family Information form [IMM 5406 (PDF, 570.00 KB)] and pay the applicable fees online.

Here assessed means, assessment for inadmissibility, which is medical, criminality and security.

After hvng recommend passed from case analyst, is thr any case of rejection from officer on eligibility?
Yes, I have seen a few. Most likely an agent in most (almost 98%) cases will agree with the recommendation made by the case analyst. But in some cases, the case analyst will leave a few ares for further review, or where the analyst is not sure, these are the cases where the agent will exercise his discretion.

So the answer to your questions is, YES. But it will depend on the nature of the case.

In all likelihood the agent will go ahead with the recommendation.

Actually, you helped on the query related to translation. What all should be part of the translated document? I provided translation of the original, affidavit of translator and certified photocopy of the original document. However, I didnt provide the copy of the original document as it was not mentioned on the site. All this was about the birth certificate of my son.

However, after learning the case of the rejection in May 2017 due to missing the original copy of the marriage certificate, i raised the CSE and shared the original copy of birth certificate of my son. However, you also asked me to send an email to Ottawa at CPC-CTD-Ottawa@cic.gc.ca.

In reply of the email, I received this response from them. What's your view - is the application with them and they have not initiated the processing? or they dont have the application with them. May be some other office.

Hi Legalfalcon, you know already that i am currently in Canada and my dependents are in my home country,so in the PPR email,it is not mentioned to submit their passport to my home country. this is in the instruction Two (2) photos of yourself and of each accompanying family member. See our specifications at www.cic.gc.ca/english/information/applications/guides/pdf/5445EB-e.pdf,this means that i need to submit their passport in Ottawa? Please advised me what to do?Should i inform to IRCC to change the vo for my dependents to my home country or no need to inform IRCC just submit in my home country.
Thanks in advance,
Rabin
