Termination of contract and work visa?

I am an employer of a live-in caregiver. She has been here less then a year and I am considering terminating her employment due to finanical reasons. She is going back to Japan for 4 weeks this summer and I may need to terminate while she is on holiday ( just timing). Would she be able to get back into Canada on the work visa that was under my famiy for the live-in caregiver program?

You would be kinder to her if you let her know now before she leaves so she could look for another employer. Timing the termination while she is out of the country is cruel as she may have difficulty entering again without an employer. There are families looking for caregivers who are already in Canada. BTW, is she a citizen of Japan? Thanks.

No she is not, she will go there first and then visit her home country after and then come back to Canada.

Well it is really sad. But you need not be the family she comes back to, to work for. She can look for one now before she leaves. Hopefully she has been good to you and your family and being honest to her now would help her. It is okay to terminate her contract but you would be helping her if she looks for a new employer then apply for a new WP before she leaves the country. It takes about a month to apply for WP for a new employer inside Canada. If you let her leave and terminate her employment while she's outside Canada, she might not be allowed to enter. She would be able to come back at a later date but she would have spent for the fare.

I have no problem giving her notice while she is away so she can start looking on-line for another family and her coming back into Canada to complete 2 weeks for me etc..this way she can stay here.She has expressed to me on many occasions that she is not "impressed" by Canada and does not have any intentions of gaining PR. Good caregiver though, we had no issues with her and vise-versa.

Thanks for your response. Probably, let her know before she leaves. So she's just here for the job and not to be a PR and citizen later. Thanks again and all the best to you and your family.

Hi there, could someone send me the link to the Immigration ( work visa) application form that a caregiver would use who is already in Canada and wants to apply for a new work visa with a different family. I went to the CIC site, but not sure which form she would need.Thanks!
