Hi Everyone,

My current work permit is about to expire in a week and I currently have 447 points .. so I am hoping to get ITA in the next draw --- optimistic.

I currently work and to apply for BOWP I need the AOR so I need to wait until I get my ITA and submit my documents to receive the AOR under CEC stream.

If I get the ITA and Apply for BOWP .. Do I still need to apply for Temporary Resident Visa to Stay In Canada ? or Just the BOWP and EE Application submission is sufficient ?

Please someone help me in this regard.

TRV is for re-entry if you're not from a visa exempt country. That means you'd need one if you leave Canada, even if you have a valid work permit. Your existing TRV may still be valid though, it does not necessarily expire with your WP.

Now if your WP expires before you apply for BOWP, then I guess you'd need to apply for restoration status if you want to stay in Canada. And you will not be allowed to work in the meantime.

One more thing to bear in mind is the processing time of BOWP vs EE itself. Currently it takes 132 days to get a work permit, while many members in this forum got PR in the same amount of time or less, so you may decide it is not worth the effort.

Thanks for the reply.

My TRV expired 2 months ago .. but my PGWP is valid till next week

so if I get ITA in the next draw and submit my BOWP application before it expires , can I still stay in canada with that ?

You can stay in Canada but your bowp is going to be refused. So at some point you'll be out of status in Canada and will have to apply for restoration.

If I apply for BOWP and continue to work and Incase if they refuse the application .. does my work - until the day app is under processing gets counted ?

It should count since you will be in "implied" status until you hear back from CIC regarding your BOWP. It will be refused though, but it buys you some time, and you can continue to work. Once you get the decline letter you will have 90 days to restore your status as a visitor.

This is exactly what I am going through. Already got my declined letter. Not working right now.

That I am not sure, since you know it will be declined. Because even if you get ITA, that will not be enough to extend your work permit (this I was told by a VIP member on these boards). You need the AOR. All my employer asked me to provide the full application and receipt that I paid the fee for my WP. I work for one of the main banks, and if they said it was okay to keep working, I dont think CIC will care... I might be wrong though. I hope I am not though since I am ready to send my application in. I got ITA on Sept/17.

Just be ready to provide proof of funds in your ITA - 12K for single applicant.

If you apply for something that you're clearly not eligible (As BOWP before sending a PR application) wouldn't that be considered misrepresentation ? I honestly don't know but would be careful about that.

What about just extending you existing WP ( on the same terms ) ?

my employer is willing to keep me as long as I am on a Legal Status, I don't have 12k funds but i am under CEC stream

is there any other way to Extend my current PGWP other than applying from BOWP (Cant get LIMA - Thats out of question)

Its definitely misrepresentation if you are applying for the BOWP when you know that you don't qualify. If I were you I wouldn't go that route because it can land you in hot water later on. When you have to fill out your Schedule A and they ask you if you have ever been rejected you would have to explain this incident.

but if I get ITA and submit my EE application and get AOR that should be OK to apply for BOWP right ?

I am hoping the points drop to 447 for the next weeks draw and I get ITA ...

So can I Apply for BOWP with the First AOR ?
