Hello Everyone,

I'm preparing for my PR application through EE stream, my partner is a Canadian citizen. Since he is Canadian already, I put him down as unaccompanying PR Spouse.
One of the questions he needs to answer is, Does he have a relative who is a citizen or permanent resident of Canada? In his case because his whole family members are Canadians, so we put 'yes' to this question, which led us to this list of documents required to be submitted in the following section:

Family Member Proof of Status (required)
Proof of PR/Citizenship of sibling (required)
Proof of residency in Canada of sibling (required)
Proof of sibling relationship (required)

Questions:
  • Since I am not claiming any points from the Canadian relatives section, (I do not have any Canadian relatives, and having a Canadian common-law is treated the same as being single in the mark calculations), do we need to provide all the above documents?
    • If No, should I attach an explanation letter to the 4 documents, to justify the reason: not providing documents on Canadian relatives, because I am not claiming points for that, ie. common-law is Canadian citizen. I would really appreciate if you could provide any guidance for the explanation letter.
    • If Yes
      • Do I need to include all pages of passports from all his Canadian family members, ie. all direct family members (parents, siblings etc.)
      • what's the recommended document to prove a parental/sibling relationship? I checked his birth certificate, and it doesn't include names of the parents
I have been trying to find answers related to this question but had no luck. I look forward to your insights, knowledge and suggestions!
Thank you in advance!

Bump. Anyone can provide some insights?

Your spouse is already Canadian and shouldn't be included in the application either as accompanying or non-accompanying.

Hello Scylla,

Thanks for your reply. The system asks what's my marital status, and once I pick 'common-law', the next question will be prompted as: are they accompanying you to come to Canada? If I select No, my partner's status automatically becomes non- accompanying spouse.

Let someone else comment. I know this has been discussed here many times in the past but I can't remember how to deal with a spouse who is already a Canadian. You basically want them excluded from the application entirely. Otherwise they need to get a medical done, provide PCCs, etc. This isn't needed since they are already Canadian. Maybe this is handled through an LOE. I don't know and you'll need to wait for someone else to answer.

Noted Scylla, thanks for trying to help!

Hi! I’m on the same boat, too. Wondering how this was settled. Thank you!
