Hi,

Tried looking for such a thread but couldn't find one. I believe my situation is very unique so wanted to ask this question.

I recently came back to Canada after 3 years abroad start of June 2023. My tax returns for 2020-2022 are nil. I just started a job on Aug 21, 2023 which meets and exceeds the LICO for 3 people. With only 4 months of income, I am thinking of submitting my parents supervisa application. My questions are:

1) Can I submit the SV application with only 4 months of income?

2) Can I submit it on early Jan 2024 right after getting my T4 along with employment letter and recent pay stubs instead of filing my taxes and receiving the NOA as that would push the application up to March 2024 or further?

3) Can I submit the application without any NOA? Even for 2022 as I had zero there and besides I will be submitting the 2023 T4, employment letter and recent pay stubs?

Thanks
Ken

Thanks for the quick reply. I should also add that I had a considerable debt against which I've signed up for a consumer proposal. If I go down the NOA route, I will also need to declare that. Also, if that happens, I am not sure whether it will be the full debt or the reduced 30% consumer proposal amount.

Also, if on the CIC website, they say either of, then why most people default to NOA? Have there been majority of cases where people who submitted other proof including T4 instead of NOA getting rejected?

Thanks
Ken

They ask for NOA as proof of income + your letter as a financial supporter for your folks where you can put bank statements. So both is needed. But i see they say NOA or T4 so yes you might avoid it in that case! Why not try!

Supervisa is based on proof of income already earned in Canada not proof of salary. NOA is the preferred proof by IRCC although you can attempt to apply with just a T4. Very few people just submit a T4. Most are close to filing their taxes if they have received their t4 which is probably why NOA is the preferred proof.

Yes it was but you are panicking way too much. If they clearly say they accept NOA or T4 you have every right to apply with T4. Its not a crime to be absent from Canada if you are a citizen. Worst case scenario you will have to clarify things!

Although it says T4 can be accepted have seen people denied if presenting just the T4 while approved when they submitted the NOA. Wait around an extra month to get your NOA and apply with a supervisa. IRCC has the preference for NOA because it gives a more well rounded picture of income versus one T4. Certainly your prerogative to try. Assume OP exceeds LICO for his family size for income earned between Sept-Dec 2023. Supervisa wasn’t really intended to allow parents to visit soon after moving to Canada (moving back in this case) which is one of the reasons for supervisa to be based on income earned and not salary. This is especially the case now that supervisa stay is up to 5 years with a possible 2 year extension. A supervisa is not meant to move to Canada permanent or move with your children to Canada. The majority of applicants apply for a supervisa over a year after arriving in Canada. No harm trying for a supervisa using just T4 in January/ early February but given that you only recently started working and returned in summer 2023 IRCC may already be concerned that you haven’t established your life without your parents in Canada before they come for a long visit. Please let us know what happens since I’m curious to hear the outcome.

Thank you again for the response. I think it's a double edged sword. If I apply using T4, obviously the chances might be a little lower as they prefer NOA. I think in my case the issue is not that the NOA gives a wholistic picture of the total income as opposed to the T4 which is only income from employment because I don't need to prove through the NOA that I have sufficient income
as per LICO for 3 people since I already meet that through the T4. The issue would be the liabilities as they wouldn't know from a T4 as opposed to a NOA which is why I'm referring to it as a double edged sword. Apply with the T4, lesser chances of success vs apply with a NOA, more chances of success but might be reduced due to the liability issue.

I'll see around when the time comes after my T4 and definitely let you know.

My parents had their Supervisa from May 2018 which just expired on May 2023 unfortunately as their passport validity was over. I heard they could have still come a day before expiry and applied for a visitors record upon landing to stay for 2 years. Is that true?

Also, is there any way I can call them on the expired super visa immediately somehow without reapplying or TRV?

Furthermore, has Canada changed the rules now and they can stay for up to 5 years without going back?

Thanks
Ken

@canuck78 awaiting your response.

Also, it would be good to have some other VIP members opinions as well on the subject. Unfortunately only you have replied.

Hi, I would like to invite my in-laws to Canada through Super visa. Me and My wife - both are PR's. I am employed with a stable income and way above the LICO cut off , but my wife is not employed . I would like to know whether we are still eligible to apply super visa for my in-laws even though my wife is not currently employed. If, we can apply what special care should be taken while providing documentation?

Thanks in advance

What was your outcome? Did you apply with just T4 or waiting for NOA?

I am new here and just starting my employment and considering between super visa and TRV

Supervisa is based on income earned in Canada not salary. Will you be able to show that you meet LICO on your NOA based on your income earned in 2023? If you have a spouse you can have them co-sign the application.
