Hi everyone,

my mom has a visitor visa and is currently in canada. now, she will go back home country in April,2023.
we are planning to apply super visa for her from outside of canada.
While we are waiting for the verdict for the super visa. Could she still allow to come back to Canada on her Visitor visa.

Yes but if she has been in Canada already for an extended amount of time it would be best to reestablish ties to her home country while applying for a supervisa. If she returns, applies for a supervisa and then returns for another visit to Canada quickly there could be concerns that she is living in Canada and not just visiting. How much time has she recently spent in Canada?

I have a similar situation where my mom is in Canada on Visitor visa..She came to canada in June 2023, and can stay on visitor visa for 6 months (until Dec 2023). Her supervisa application was initiated on April 2023, while she was in India, and is still in progress. IRCC requested for medicals in Canada for her supervisa application, which will take another 2 months to get sorted (probably till Jan 2024) as the panel physician wants to perform additional tests on HIV etc.
1. Can she still stay in Canada on visitor visa for more than 6 months when her supervisa is in process?
2. If she cant stay for more than 6 months, what are the options available for her?
- Can she apply for an extension of stay under her visitor visa?
- Any other options?

My wife is pregnant and we would require additional support from my mother during this period.

Thanks for your response!

Supervisa application does not give you implied status. She can attempt to extend her status as visitor. Pregnancy does not guarantee the ability to stay in Canada. If there are health complications like strict bed rest during pregnancy then Actually indicating that you may be cooking, cleaning or looking after a baby is actually considered working illegally as a visitor.
