Hi, my parents super visa was refused last week with following reason
- You did not provide proof that your child’s household meets the minimum necessary income from 2020 or 2021.
I provided my employment letter that stated I'm employed at current job since July 2021 with a salary which is higher than the required limit. So very surprised at the refusal.
Any tips on what else I should include before reapplying.
Thank you
I had the exact same refusal even though I provided the following:
1) last 6 months pay slips for both me and my wife.
2) Last 6 months pay statement showing salary deposits for both me and my wife.
3) Employment letters from both hers and my employer clearly showing our salary, job title, working since.
The only thing we did not provide was NOA. As per IRCC requirements, NOA is not a required document (no matter what self claimed IRCC specialists say on this forum). Ref -
https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/visitors/super-visa.html. It clearly says and I quote "
The following documents are examples of what the child or grandchild, including the co-signer, can use as proof of financial support:
- notice of assessment (NOA) for the most recent tax year Footnote2
- T4 or T1 for the most recent tax year Footnote2
- pay stubs
- Employment Insurance benefit statement, including:
- a letter from an accountant confirming the child’s or grandchild’s annual income, if they are self-employed, and/or
- proof of other sources of income (for example, pension statement, investments)
- an original letter from the employer stating
- job title
- job description
- salary
- bank statements"
Nowhere it mentions NOA is a required document. And the link I posted is the manual that IRCC agents refer to, to make decisions on applications.
Anyways I did not have my NOA back when I applied first time but when I applied 2nd time I had already received my NOA so I attached that. But I did consult 2 proper Immigration lawyers and both confirmed I could have taken IRCC to court and won the case in 1st Judicial review even (without going to court). 1 lawyer even said he won't charge me anything until I have won the case, that is how confident he was about the "not-so-clear" guidelines.
I would strongly suggest write up a proper explanation letter including screenshots from IRCC website and maybe use a lawyer and re-apply.
