Super visa for widowed mother (I'm the only child)

Hi all,

I am presently in India and would be moving to Canada on PR in few months. My wife will move in later as the dependent (I am the primary applicant).

My query is about my mother. My mother's situation:
-71 years old
-widowed
-I am the only child
-she has always stayed with me
-she has mild hypertension (blood pressure) since 30 years, but regular medication keeps it under control. General health is good otherwise.
-dependent on us financially and emotionally

I hope to bring her on parent super visa as soon as I start my job in Canada.

Queries on super visa:
-is it possible to apply for a super visa for her after around a month into my job in Canada (or how soon)? (salary or financials wouldn't be a problem)
-is there a quota/window or I can apply any time of the year?
-her brother and sisters (my uncle and aunts) would be her only ties to India if she moves to Canada. is it a problem?
-would her age or health (hypertension) be a deterrent for grant of visa?
-would I get a Canadian medical insurance considering her age and medical history? any indications on how much would it cost?
-once the super visa's first entry period of 2 years is over, when can she visit us back or what would be the next steps?

If super visa doesn't work out, what are the other options (including humanitarian or compassionate grounds)?

Ideally, I would want that my mother can travel together with my wife to Canada within 2-3 months of my landing. Apologies for the long post - but if my mother can't join us in Canada, we don't move to Canada : )

- You can apply for a super visa as soon as you have a job in Canada that meets the low income cut off.
- No quota.
- Yes, that could very well be a problem. To be approved for a super visa (even a regular visitor visa), your mother will have to demonstrate ties to her home country. Does she own any property? Have other assets that demonstrate ties? Keep in mind that a super visa doesn't allow her to move to Canada. All it does is let her visit for longer periods of time.
- The hypertension should not be an issue.
- I don't know how much insurance would cost.
- How long she is allowed to enter Canada is up to the border official keeping in mind that a super visa does not allow her to move to Canada. If she stays two years and then wants to stay longer, then she can try applying for an extension from within Canada. If the extension is refused, she will need to leave Canada and should remain outside of Canada for at least six month before attempting to return.
- If the super visa doesn't work out, H&C is only an option if she can get to Canada on a regular visitor visa (she has to physically be in Canada in order for you to apply for H&C). Otherwise the only option is PR sponsorship which will take a very long time (it will take four years just for you to qualify to apply).

Long story short, there's no guarantee you will be able to bring your mother with you to Canada - and no guarantee how long she will be able to remain here if she is able to come. None of us can predict what will happen.

Thank you so much for the clear reply! Still, I think its worth taking the risk for me to come over to Canada and apply for her super visa.

On ties back to home country: she doesn't have a property in India on her name (its on my name). However, she does have her bank accounts, bank lockers (jewellery) and her brother and sisters. Would that be sufficient to prove her ties? She sometimes teaches English and history to the kids nearby (for free) - can I show this as a job for which she would need to come back? I might be sounding stupid :/

It's hard to say if CIC will see this as sufficient ties. Having said that, by all means give it a shot.

I wouldn't bother mentioning the teaching given she is not paid and the volunteer work is not regular. I don't see how this volunteer work would obligate her to return.

No, it's not. OP needs to meet LICO and the widowed mother has to undergo medical examination. On the contrary, the regular visit visa does not have that requirement. She can try applying while she is in India.

It really isn't as it's a longer and more cumbersome process that could take several years to process (with the caps in place). In comparison, the Supervisa could be obtained in a month or so.

My main concern would be to get my mother to Canada first, through either super visa or visit visa, whichever is easier. Once my mother is in Canada, how strong is my case for Humanitarian and Compassionate grounds, and what is this H&C visa/process like? Would she be allowed for a longer stay if H&C application is successful? My salary would easily be above the Low Income Cut Off, if that fact helps me.

H&C would be a hard sell when PGP sponsorship is available for you to use, more so when you have income to meet LICO requirements.

The only thing going for you for H&C is the fact that you are her only child, assuming your mother has no relatives looking after her.

Ok. Super Visa is my first option. If that gets rejected, I will have to go for H&C. My mother cannot stay alone by herself in India, so cannot wait to sponsor her on parent visa as I understand this process takes time and has a quota. Both visitor visa and Super Visa have a primary condition that the visitor needs to have sufficient ties back to home country, and this is difficult to prove.

But H&C can only be applied once my mother is in Canada, right? Isn't that a Catch22 situation? Is my case weak for H&C?

From what I understand, that is correct. H&C can only be applied once your mother is in Canada.

That's exactly right. She needs to be physically in Canada for an H&C application to be submitted.

So for an H&C application to be submitted, she needs to come to Canada on either a super visa or regular visitor visa.

If she is outside of Canada, H&C is not an option.

"We received sufficient applications to meet the Parent and Grandparent Program cap this year. The application period is now closed but will re-open on January 3, 2017, with a cap of 10,000 new and complete applications."

Apart from super visa, is this is the other option (PGP)?. I have heard this window closes within a week as the cap reaches quickly. Still, theoretically, I can apply for this one as well, as soon as I start working in Canada (given income requirements are met)?

PGP is the only other option. It opens next year, Jan 2, 2017. It accepts 10,000 completed applications on first come first serve basis. You can apply provided that you can meet lico requirements for 2013, 2014 and 2015. You can add your spouse as co-signer if you do not meet the lico requirement by yourself (if this applies to you).
