Has anyone ever successfully appealed a refusal of authorization to return. My spouse who I am sponsoring was refused the PR visa because the ARC was denied. The reason for the refusal seems to be previous immigration history. I need a representative who has positive experience with cases like this. Thanks

Agreed, more information is required. It would also be helpful to know why a deportation order was issued in the first place.
which visa office you are dealing with? pls explain what you mean by previous immigration history.. I also need ARC and I am stressed to see your post... Is it really hard to get ARC??4evernlove said:

My spouse initially came to Canada as a visitor & overstayed. During a ride stop was turned over to immigration. Applied refugee - was refused. Did not leave however from the initial immigration hold was always reporting to CBSA Airport Road. During reporting my spouse when then issued a deportation order but had a domestic case in court so did not leave as case needed to be cleared up. Still reporting to CBSA - eventually case was heard & completed - No criminal record. Was asked to go to CBSA where departure date was set. My spouse left Canada by that date. All this over a 10 yr period
In a nut shell that is it - All this was mentioned by the Program Manager as they stated all immigration related stuff and also made mention of the fact that there is no criminal record. I guess they just think they want to grant the ARC.
So back to the initial question does anyone know of someone who went through something similar and was successfully.
The genuineness of the marriage or anything else was not in question.

Visa Office is Port of Spain - I thought we would have gotten the ARC so was a not so pleasant surprise when it was denied so I really do not know the probability of getting one since it is at the discretion of the visa officeVijender_Rana said:

This was not mentioned as the reason. I do not understand why this would or should be held against him. They had their day in court and he was vindicated by the courts. The thing is the granting of an ARC is so subjective so it is hard to say what the real underlying reason is.aroundwrd99 said:
