I just wanted to let everyone know that I received my decision on my appeal hearing. The judge
decided that there is sufficient credible evidence that our marriage is genuine. The officer's decision
to refuse a permanent resident visa is set aside and an officer must continue to process the application
with the reasons of the IAD.
We are so happy. We're not sure if it will continue on immediately but we're hoping so. Originally we
assumed we would just get a letter saying he was getting his PR status. But well I guess soon! :P

Congratulations Mrs. Turan! I've been reading your posts and was just on the sidelines waiting for your appeal's outcome. I'm so happy that you won the appeal!!
 
Me too! Thank you lovely and scylla.I can hardly believe it yet! But do you think it will happen fast now? My husband getting his PR and coming. We're almost burnt out, but this news has definitely energized us a bit more.

According to the website, Ankara's processing time is about 6 months. So I guess it will be done in 6 months! I know it's still a long wait but the end is almost near for you!!! Hang in there!
 
Why would it be that long? I thought all they needed was his medical and police report updated and then he'd be coming. He's already been through everything already. Oh noooo!
 
Yeah, baby yeah!!! That's fantastic, I have been crossing everything for you from fingers to eyes!!! Hooray!!

Your successful appeal file should go to Ottawa for the processing to be completed, according to the new protocols, and your husband's PR should be issued from there provided there are no additional concerns re security or anything like that. Whatever happens, you're coming home to Canada together, woot! :D

if you dont mind me asking, why was it rejected to begin with, what kind of evidence did you submit for proof of relationship? did you submit other evidence at the appeal hearing?, im just curious as I would like to learn from your experience so that I can make my application strong.

unfortunately not all files go to Ottawa as Charlie said...some go which would be faster (it's a pilot program, new one for this year) but i also read of some people who got their file back to the respective VO, Ankara in ur case....now they should take ur file directly and continue where it was left - maybe further background checks, security, etc....if they did that already, then u r close....but some complained that their file after the appeal was back in the initial line :-X hope it's a mistake and they don't do that in general
also, nothing to be scared, just keep in mind that successful appeal does not mean 100% PPR....if it's the same officer getting back ur file, she could/try to find other reasons to reject (which is also why they suggested the pilot program going on now)...

how did ur hubbie take the news? :D will u go back to wait together for the final step? :D

Congratulations!!! Thats happy news! I have been following your story and was hoping you would win your appeal. Im soooo very happy for you guys!! You guys have gone through a lot and been apart for many years. The end is near, just hang in there :)
 
Congratulations. That is truly wonderful news for you and your husband.

They have a new office in Ottawa to process applications that have been won on appeal which is "probably" where the file will be processed now. Your husband will require a new medical and be required to fill out a few of the forms again (App for PR, etc.) just to update his file. I wish I could tell you how long it will take for the file to get transferred there but it's really new so I don't know. But hoping it will be quick. Keep us posted.
