Hi, I got accepted into a college in Canada last month, and I applied for a study visa last week, however I already received a rejection letter, and the reasoning for the rejection was as follows:

You have significant family ties in Canada.
You have limited employment possibilities in your country of residence.

As for my defense, I absolutely have no family members at all in Canada. I also am currently employed, and I proved this in documents during my application. What should I do?

Dear **********, Thank you for your interest in studying in Canada. I have reviewed your study permit application and supporting documentation to assess whether you meet the requirements for a study permit (https://www.canada.ca/en/immigration-refugees-citizenship/services/study-canada/study-permit/ eligibility.html). This includes assessing whether you are coming to Canada temporarily for the reason(s) you describe in your application.
I have determined that your application does not meet the requirements of the Immigration and Refugee Protection Act (IRPA) (https://lawslois.justice.gc.ca/eng/acts/I-2.5/index.html) and Immigration and Refugee Protection Regulations (IRPR) (https://laws-lois.justice.gc.ca/eng/regulations/sor-2002-227/index.html). I am refusing your application.

• You have significant family ties in Canada.
• You have limited employment possibilities in your country of residence.

You are welcome to reapply if you feel that you can respond to these concerns and can demonstrate that your situation meets the requirements. All new applications must be accompanied by a new processing fee.

Sincerely, Embassy of Canada Visa Section Cinnah Caddesi 58 06690 Cankaya Ankara Turkey

So does your current job have anything to do with HR? Is the program a post graduate level program? How did you justify the costs of the program with your future employment prospects with higher pay than you have now? I don’t see career advancment/progression nor expanding on your psych degree.

My current position isn't related to HR but the company is owned by my parents and are looking to expand with a HR position. It is a year long certificate, not a post-graduate program. I stated that I will return to Turkey after getting the certificate and take the position of HR Manager in my current company. I am not expanding on my Psych degree, however HRM is a program that would support my current career route and is supported by my knowledge in Psychology field. This is all still irrelevant to the reasoning, "Significant family ties in Canada" as I don't have any relatives in Canada whatsoever.

Not sure why you got the second point if no family in Canada. Did you state in your SOP that your parent‘s own the company? If parents own the company then why do you need to come to Canada to study? Wouldn’t taking an HR program in Turkey based on your country’s HR rules, regulations and laws be more beneficial?

I stated it, yes. In fact we own two businesses that work hand-in-hand, also stated in the SOP.
As for your second question; I chose studying Canada over Turkey because I trust the College of my choice to be much more efficient than the alternatives in Turkey, and getting my certificate in Canada will be much more useful in accomplishing my future goal of taking my business to Europe.

Weird case yours, are mix-ups even possible in their system? This sure sounds like a mix-up. Order the GCMS notes; IDK about speaking to lawyers, but do seek advice about seeking a judicial review.

Ah…that is unfortunate that you mentioned family run business. VO will wonder why you can’t study in Turkey or Europe. Being family run, you have the job so you don’t need the education. Is the program a graduate level program or diploma? Make sure it is a post graduate program at a public DLI.

Truly, I suspect a mix-up as well, perhaps due to my surname being one of the most common surnames in the entire country. I am also baffled that they came up with this conclusion in merely a week of inspection.

Order GCMS notes for full reasons for refusal. It may require changing programs, and justifying why you need to come to Canada (spend thousands) and take a program when you are returning to a family business. You need to show how your career will pay off the cost of such a program. HR is based on Canadian standards and regulations so show how HR studies relates to HR practices in Turkey.

Thank you for being so helpful since the beginning.

I will be applying again with an appeal, already wrote the letter for my appeal requesting closer and thorough inspection of the so-called family ties, and my ongoing career in my home country. If I receive another rejection, I will take the ordering GCMS notes route, or possibly seek another alternative than Canada, sadly.

Hi Everyone,

Naturgrl commented " Ah…that is unfortunate that you mentioned family run business"

I don't understand how can that be a problem. I agree that most people do have corporate jobs and it's easier to say that I will come back and get a promotion and will be in a much more senior position than before..But, what is the problem in saying the same for a Family business?

Let's say, right now I am from the accounts section and I work with my family .. However, I need an MBA in analytics to be able to expand the business, Does that sound illogical to the VO ?

Please elaborate so I can sound logical. Thanks Naturgrl
