This started to be a huge problem. My partner is graduating in april and if he graduates before this extension approval, he cannot work after PGWP application, meaning that he cannot apply for my SOWP without working. We will both lose our jobs and status here just because evaluation is taking too long. (July 15 applicant)

Your MP represents your constituency where you live. Go on the Parliament of Canada website and find your MP.

Hello everyone. I want to share my friend’s spouse case. She applied sowp extension on 27 pct. today she got refusal and reason is “
[X] You have not demonstrated that you are eligible to apply for an Open Work Permit under the
Immigration and Refugee Protection Regulations because your spouse is not enrolled in an
eligible pilot, graduate, or professional degree-granting program.
[X] We also wish to advise you that your temporary resident status expires on February 14,
2025”. But this rule came in November and January. Why she got refusal. What she can do now?

Thread is about study permit extensions. So how is she eligible for SOWP. Status of spouse - program? When did she apply for extension - 27th pct? She is now out of status so must stop working.

Main applicant is on study visa. She applied for sowp extension. What can she do now??
Masters/PhD? When does study visa expire? When did she apply to extend? Seems like IRCC is not grandfathering in spouse’s on permits. May want to hire a lawyer. She cannot work until SOWP is approved, if eligible.

This should not matter as she said she applied before November 1 when all those SOWP rules started. And also, it’s an extension.
She should definitely try getting a lawyer or/and applying for a reconsideration

What does November 1 have to do with it? Changes to SOWPs for those whose spouse is on study permit changed in March 2024. Seems like IRCC doesn’t “grandfather” in extensions.

Can you give the link stating the extensions are not included. This will help others who may get refusals.

I don’t know how i can attach a screenshot, but scroll down, you’ll find this

“OWPs that were approved under the previous measures and have not expired will remain valid. In situations where students may need more time to complete their program or where family members received a shorter work permit than the principal applicant, in-Canada family members (including spouses and dependent children) can apply to renew their work permit as long as

  • they are applying under the same criteria as the current work permit, and
  • the requested duration of the renewal matches that of the existing study or work permit of the principal applicant”

This rule apply to file after 21 jan. But my friend applied on 27 oct. One of my friends got sowp extension, she applied in November.

That’s what i’m saying. According to this rule, they should be able to extend their permit.
Even during the initial SOWP changes that happened in March, people with valid work permits could extend too without the new rules affecting them.
IRCC guys make mistakes all the time.
Apply for reconsideration and/or consult an immigration lawyer.
