My friend who is PR of Canada is staying with his Canadian husband for 4 years in UK.

My question is Will she have any problem entering Canada with her husband. They have their businees in London UK.

No issues as long as she has a valid PR card or a valid PR Travel Document.

You work outside Canada

You need to work full-time for:

• the Canadian federal, provincial or territorial government

You travel with a spouse or common-law partner

Your spouse or common-law partner needs to be:

• a Canadian citizen, or
• a permanent resident working outside Canada, full-time for:

  • the Canadian federal, provincial or territorial government

There has been much debate regarding `who followed who' when a PR is living abroad (not traveling) with their PR spouse/partner. If the PR `followed' the Canadian to live there, those days abroad definitely count towards their R.O.. If, however, the Canadian followed the PR, meaning that the PR sponsor really had no reason to reside outside of Canada otherwise...it could be questioned when the PR applies to renew his card. Having said that, I suspect that this is rarely ever a real issue, but just sharing the information that has been discussed in these forums.

Did your friend ever live in Canada after getting their PR? For how long? That will impact whether they are guaranteed to count time abroad towards RO.

Yes that may be problematic for counting time abroad with your Canadian spouse. Counting time together abroad is really meant for after couples have established themselves in Canada first and then moved due to the Canadian’s job or other reasons. To receive PR the couple was supposed to relocate to Canada. If they had applied today they would be required a lot of concrete proof that they would be moving to Canada. If they move to Canada when her PR card is still valid then she will likely be fine. If she applied to renew her PR care and tries to count time in the UK or applied for a PRTD based on time in theUK it could be an issue. Applying for PR is really meant for when you are relocating to Canada at least initially.
