Hello,

My fiance(to be wife) wants to visit me for 5-6months and wants to work remotely from Canada for a German employer. She holds a visitor visa. Does she needs a work permit to work remotely for a German company (income will be paid by the German company to her German Bank account).

As per this link https://www.canada.ca/en/immigratio...y-residents/foreign-workers/what-is-work.html (working remotely for non canadian company and who is paid from outside Canada is not considered as work. Hence I assume she does not need a work permit. Is it true ?)
  • long distance (by telephone or Internet) work done by a temporary resident whose employer is outside Canada and who is remunerated from outside Canada.
Also, my fiance (to be wife) employer wants to get this confirmation from a Canadian authorities so that they can allow her to work from Canada. How can I confirm this from Canadian Immigration authorities. Through web form ?

There is a new rule launching soon, Digital Nomad program. Can my Fiance eligible in this program ?

She can if the company has no Canadian clients/customers and no Canadian offices. Digital Nomad policy was announced in a speech with no timelines nor outline of requirements.

If it's a large bank then it will almost certainly have Canadian customers / clients which technically means your wife would need a work permit in order to work in Canada. You can certainly send a webform to IRCC however they will not comment on the specifics of your wife's situation or provide her with approval to work without a work permit. You can expect a response that is general and points to policy. But as said, you can try.

I think you will have to wait for the digital nomal policy to launch before you'll have anything you can provide to the employer. No idea how soon that is happening. Sometimes IRCC is fast and sometimes things take forever.

No harm trying the webform.

Another thought. If your wife / fiance happens to be a German citizen, then depending on her age, she can look into the IEC Working Holiday visa which would give her an open work permit in Canada. An open work permit allows you to work for any employer. Then she could certainly work remotely without any questions about whether her employment situation fits the rules.

If she was working under a OWP the German employer will need to make changes to their payroll because she will no longer be a tax resident or Germany she will be a tax resident of Canada. She may want to discuss with her employer possible changes in terms of how she gets paid like working on contract. Would suggest speaking to a tax accountant in Canada about how best to set up work for a foreign employer.

OP does not state that she works for a German bank, only they should would be paid "...to her German bank." I think she's ok, per the link that the OP posted (which I recall seeing many, many years ago;)). That same linked `helped' someone I know very well!

If she is in Canada less than 183 days, she wouldn't be a tax resident, correct?

are a tax resident. You can actually be a tax resident without spending one day in Canada
