Spouse PR - Date of Birth conflict & Document Bureaucracy

Hi Everyone,

Your posts have always helped me and this is the first time I am posting few questions for unique situation

I am a Canadian PR holder, about to get married and lodge Spousal PR for my wife and I have following question.

(1) Will my wife be asked to to provide School Leaving Certficate OR the Birth Certificate?

• Asking because she has different date of births in both of these documents.
• Her passport has the same date of birth as her school leaving certificate.

Why she has different Date of Births?

• She was born in a village where people never valued the importance of legal documentation
• No one bothered for official birth registration nor they cared for putting in correct or accurate dates.
• So due to the carelessness and igorance, she ended growing up having different Date of births in different IDs.

Summary of Date of Births

• 1986 - on the School Leaving Certificate and Passport
• 1989 - on th Addhar, PANC, and Voter card
• 1988 - on Birth Certificate

Detailed Explaination

School Leaving Certificate & Passport - Birth year is 1986​

• Because her mother had messed up the birth date during school admission
• So the School Leavning certificate shows her as born in 1986
• Now the school has refused to update this.

• When she applied for the passport in 2014, she used her School leaving certificate as primary DOB document.
• So her passport contains the same Date of Birth as the School Leaving certificate.

Aadhar Card, PAN Card, Voter ID - Birth year is 1989​

• When she first applied for Aadhar Card, her mother wanted to fix the date of birth.
• They always believed and always told her that she was born in 1989.
• But they could not get the Birth Certificate in time from the Village Panchayat.
• So some stupid guys in their village who was incharge of issuing Aadhar Cards, entered the Date of Birth as 1989.

• She then used the Aadhar Card as the primary proof of ID
• And applied for PAN Card and Voter ID card with same date of birth
• So her Aadhar, PAN and Voter ID carries the same date of birth

• NOTE: The Aadhar Card department has informed that they can not change the Aadhar Card Date of birth.

Birth Certificate - Birth year is 1988​

• Recently she was required to present the birth certificate due to land ownership transfer.
• So one of her family member bribed/used contact to get the Birth Certificate copy from the Panchayat
• And that came out as 1988.

Confusion

(1) Shall we change the date of birth on her passport to match with Aadhar Card?

• If we do this, then will the Immigration department ask for the School Leaving Certificate or Birth Certificate as well?
• Becuase if they will, then it will be a miss match.

(2) Shall we keep the Passport DOB as is?

• So if the Immigration department asks for School Leaving Certificate then there will be no issue as they both carrries same DOB.
• But if the immigration guys ask for birth certificate then we will have conflict.

Personal opinion only: provide the birth date as in the passport (that's what IRCC will need and will use in documents), and write letter of explanation about the conflicting dates in other documents.

You can also try (in parallel) to get these things fixed - but that's not a Canadian issue.

Will IRCC care? Hard to say. They may ask later to provide some evidence you've tried to deal with it, but no way of knowing what they may want. They may instead just want evidence to clarify that these three people with different birthdates and same name are the same individual. Suggest you apply as above and see what IRCC asks for, get ready and do research in parallel.

Again: passport/national docs and dates are the ones IRCC will use.

No direct experience - if there is, it will be from other Indians. My impression is that you are not the first to have an issue with conflicting documents, and it won't be the end of the world.

What was the outcome in your case. Did you manage to satisfy IRCC with the explanations. I am in kind of similar situation. I will really appreciate an update.
