hi Friends,

I work in Canada and my wife is also in Canada on visitor Visa.
According to my knowledge, my wife is eligible to apply for '(SOWP) Spouse Open Work Permit inside Canada'.
Although she is a visitor for now, but I have work permit here. Therefore she is eligible.

Any suggestion pls ??

Hi
I am working in edmonton under noc b category on pgwp. My wage rate is 12/hr.
My spouse is a software engineer in india with 3 years of experience. I want yo apply for her open work
Permit.i got married last year in may and after 2 months of marriage i applied for her visitor visa but got rejected reason was home ties. She met some consultants in india but they r saying that she can't apply for open work permit without Limia.
A nd advicing to apply for again visitor visa because it is having more positive chances.

Please advice what should we apply for.
For open work permit what documents are required and which forms are needed to be filled.

Thanks

CIC processes applications mainly by the visa office of current country of residence. However, for family cases they MIGHT process them together in which case you might get a result soon. However, there is no way to predict that. Any of these 3 options are possible.

a) You both get it processed together - with in 1 to 2 months - best case.
b) Yours get processed now but her's take the standard processing time - likely.
c) Even your application gets delayed and both of you are processed together but late according to her local embassy - less likely but possible

Since she is your dependent and that is the only criteria for her application, it would surely be dependent upon yours being approved. Since your current wp is valid for less than 6 months by the time hers can be approved, your CP does not have any weightage in this, unless you had a year left in current, and she applies and get it for at least 6 months validity.

Hi fkl,

Thank you for your inputs, you have been really helpful with the information that you have provided. I guess I will go ahead and apply first to have my work permit extended and then apply for my wife's SOWP.

Thanks again!

There are a few criteria you need to meet for your wife to be eligible.

Applying for a visitor visa for your spouse while you are working here is always risky. The chances of rejections are high because you will not be able to prove that she will go back after 6 months.

You can apply for her work permit if you meet certain criteria. She need not have an LMIA. She actually need not have a job offer either. AS long as you meet the criteria mentioned in the link below.
